Insurance Still under Review after Two Weeks (Not at Fault Accident)

Someone hit my parked car on the street almost two weeks ago, daytime.

Some genius called ambo, cops & fire all for little oil spill on road from other party's vehicle. I wasn't there so towing truck took both cars in their yard. later I received other party's details etc and $350 towing bill under my name 😕. Moved recently, our street is not that busy at all, maximum one or two cars parked on road all time, so plenty of room for the traffic etc., yet I was told that cars gone for traffic safety reasons.

Now working on other party's insurance claim but no reasonable response from the insurance. The claim still "under review" so can't do anything like repairs or rental car, or even reimburse towing expenses billed under my name. Other party is not answering their phone after first call (holiday voice message, which sounded legit and genuine initially. Police can't intervene any further other than giving me other party's details.

What are my options now? My insurance pretty cheap, want some money to work on that claim plus I don't have hire car option on my own.

Additional info- both vehicles are roughly 10-15 of age SUV, other party just purchased theirs on the same week of accident, RBT negative on the date of the instance.

    You can suggest to their insurance company that you require a hire car and heard that there is a company called Right2Drive that will provide one to not at fault drivers. Unless of course they want to provide one until your car is fixed.

    That is who attends normally for a reported car crash event.

    Now working on other party's insurance claim but no reasonable response from the insurance.

    You're not their client, but what are you expecting from them? They have said

    The claim still "under review" so can't do anything

    Generally means the other party hasn't paid the excess, so the claim isn't progressing.

    What are my options now?

    Lodge a not at fault claim with your insurance. They'll deal with the other parties insurance etc.

  • If it's still outstanding, call their insurance company and:

    1) request their formal escalation/complaint process to start due to the "longer than average claim processing", and mention you're ready to escalate it to the insurance ombudsmen. Their formal (internal) process is important - it has to have been completed before the ombudsmen will accept a complaint. Just make sure you're ready to have the "car value negotiation" phone call at any moment, because their escalations team will probably call you pretty quickly - do your research on carsales, redbook etc, and have a realistic number ready.

    2) If you still haven't heard back in say 2 business days, lodge a complaint with the insurance ombudsmen. The insurance company will get a complaint notification and try to close your case as soon as possible. Just bare in mind that you'll need to be ready to follow through with the complaint, which can take a bit of effort on your behalf.

    The insurance ombudsmen is a government mandated industry institute that is paid for by fees/fines charged against insurance companies, when a complaint is lodged (among other things). That's why they'll be keen to make your claim disappear before it reaches them.
