Received an email from Secure parking for their active August campaign. If you book a bay between the 16th and 30th of August they will send you a code for a $50 New Balance Voucher for use on the new balance website on full priced items.

Link on their website has the following terms and conditions:

Applies to all online parking bookings with Secure-a-Spot:All customers who book parking online with Secure-a-Spot between 16/08/17 and 31/08/17, will get a $50 off New Balance promotion code for use when shopping online with New Balance. Your promotion code will be sent via your registered Club Secure email address with 5 days of your booking.

Terms:

  • New Balance promotion code expires 31/12/17.
  • FREE shipping included.
  • For use with full priced products, excludes Digital Sports (Watches).

  • I understand that we were abusing their deal, but that isn't a suitable reason to break their contract. ACCC will support consumers on this.

    I included in my email to them that they should provide a solution to all affected consumers without complaint, which I would recommend everyone to do so as to not have to individually submit complaints. That said, the more people that complain, the more likely we are to get a solution.

    Just wish to give an update. Not an official recount or statement, but just sharing some information.

    Had drinks with someone who works for (A***). I casually mentioned this case that had happened and he/she did say that the organization would generally take note of cases like this, because it involves sizable companies so there's a good chance for the case to be taken seriously if enough complaints were sent in, especially since it involves two big companies (namely Secure Parking and New Balance).

    Of course, that would depend on the volume of the complains alongside the merits of the case and many other factors, but he did mention that based on the facts presented to him on a surface level, there's a good chance for the companies to get into some trouble. He/she is not in charge of making the decisions directly or picking of the cases, but just merely sharing his/her limited insights.

    Good luck to those of you who had sent in emails. If they do choose to ignore after your attempt/s to communicate them in an effort to resolve this, then you should know where your next query will go.

      Sure hope someone does. To think a company the scale of Secure Parking would do something so shameless to its customers.

      I liken it to a bank holding a signup promotion for credit card for $100 cash upon signup, and then when people decided to signup for the promotion, they then change the terms to include *$100 upon signup and with a spending of minimum $5000 within 3 months.

      That's essentially what Secure Parking is doing to us and they won't get away with it.

    Despite pointing out in my email to Secure Parking that my bookings are made prior to the change in T&C, all I receive in response is a generic reply that all bookings made after the change are bounded by the new T&C. I bet they don't even bother reading the complaints.

    Should make it a point in your emails it is not 'footwear only', but 'FULL PRICED footwear only'.
    I would be quite happy to buy footwear on sale, but can't even do that.

    No reply yet from secureparking regarding this fiasco. Whoever at securepark thought they can get away with new T&Cs being applied retrospectively to vouchers issued when the old T&Cs were in place has quite the imagination.

    Trying to force their new conditions and expecting me to use 16 unused vouchers to buy 16 pair of shoes is ridiculous! I have been paying them over $25 every single day in parking along with a bunch of other colleagues. And this pathetic stunt has not been appreciated by any of us so they are about to lose quite a few customers for sure.

    Next stop- ACCC! Now is anyone willing to share a template for that? :P

  • So I had a reply from Secure Parking telling me to refer to the T&C's saying that it is only for Full Priced Footwear, don't know if they even read their emails properly.

  • The first email I got from them was the generic reply about T&C. When I replied back asking them to honor the original T&Cs because they were what I had agreed on, I got the following response (feels like they are mocking me with the "simple language" comment):

    Thank you for your email.
    As simply put as possible (and without prejudice) because often simple language can be read in multiple ways.

    All codes are being honoured by New Balance and can be used to purchase products giving a discount of $50 off full priced items. The terms in effect did not change, they were merely updated to better reflect how to use i.e. on footwear, as footwear fits the criteria. This was necessary because some users were trying to purchase $0 value items using code and applying for multiple codes by booking low value parking and not showing up sometimes 19 times!

    Should you try to use these codes for a $0 transaction the automated system says you get free shipping only, this does not mean it does not work, it means the item was either below $50 or excluded from promotion as per terms.

    • This feels like such a contradictory statement by them.

      You could keep that email to show ACCC that they're misleading consumers. How can they claim the terms did not change when it indeed was changed. That reply from them is in my opinion the most patronizing reply I've ever seen, filled with contradictory statements and quite honestly, the person who wrote that clearly has no clue what he or she is talking about.

      Besides, why is it of their concern even if consumers book but don't show up. If I sign up for multiple credit cards and only use them when they have cashback or when they have some benefits, should banks then revoke the benefits and change the terms and condition at the very last minute? It does not mean that we have to show up for the parking even if we booked it, what's more important is we paid for it and they receive cash for it. They should have included it in the terms and condition if they didn't want people to do that or limit the number of vouchers received per account, instead of encouraging them by stating "Get a voucher each time you book a parking."

      *EDIT: in fact, you should ask them now, name me an item in the store APART from full priced shoes that I can use my voucher with. since shoes were just an example.

      I note that there is nowhere in the terms that says that you have to actually show up for parking. What if something came up and we couldn't show up? Are they going to give us our money back if we told them we didn't show up. No. They have taken our money, and don't want to fulfill their end of the deal. They are probably reading this post.

    Gave a call to Secure Customer Service last week and all they did was get me to email them my problem. I haven't received a reply from NSW and VIC Secure Customer Care thru email and will be going to ACCC next if they do not reply soon.

    Came across articles of similar nature and I believe we have a good chance in this. Lets just give them a few more days to see if they are willing to settle it amicably.

    Emotions aside, how unlawful is the T&C change actually?

    I've complained via e-mail and received a rubbish response. I've contacted the ACCC.

    Does anyone know if an ombudsman would get involved too?

    • T&C have been agreed between us and Secure Parking on meeting their specific requirements at time of booking.
      It is not so much the change in T&C, but the fact they are not delivering on the agreement as per originally agreed.
      They are breaking a contract.

    This would be the place to report. I would personally be reporting once they do not give a satisfactory reply (or choose to ignore), by the due date that I've stated in my correspondence email.

    For those that are lazy to write in, perhaps I'll draw up a template when I'm free later, but I recommend that each entry be unique so that we will be able to get the attention of the ACCC.
    We have to stand united in an effort to stop merchants (Secure Parking in this case) from performing acts like these, which is violating our consumer rights. Besides, all it takes is 10 minutes of your time.

    You can also include a screenshot of the email that you received to show that you received the email with the old T&C, but they forced you to abide by the new T&Cs, which are substantially different and are not honouring your request for them to honour the contract as per sent out in their email.

    • Thanks, I have contacted ACCC. I think if there is enough of us that make contact, ACCC will have to review this issue, contact Secure Parking and hopefully help us resolve this. Secure Parking seem to have little intention of trying to resolve this with us or honouring the original terms.

      Edit: With the change in terms, I feel like I'm left with a bunch of useless vouchers seeing that New Balance is on sale every second week and Ozbargain is big supporter of their sales.

        Their on sale shoes are better value than full price + coupon. Essentially the coupon is worthless.

    Regarding the $50 New Balance campaign- as per Club Secure terms and conditions, Secure Parking reserves the right to change offer terms at any time. As
    per the notification on our website on 19/8/17, the terms of the new balance $50 offer were changed to cover purchases of footwear only. If your voucher
    code is only showing free shipping, please add a footwear product to your cart and the promotion code will work.

      They are referring to the Club Secure terms and conditions. The issue isn't with the Club Secure terms and conditions.

      But with the $50 off New Balance Terms and Conditions, which they specifically separated into a few dot points and made no reference that the Club Secure terms and conditions apply, or that the $50 off New Balance Terms and Conditions are subject to change at anytime.

      edit: you could even close your Club Secure loyalty program, thereby ending the Club Secure T&C agreement.

      Club Secure loyalty program and the $50 off New Balance code are two separate agreements, there is absolutely no indication that the T&C are related.

    • The old vouchers don't have the footwear restriction. I can show a voucher issued on the 27th that does not say footwear only. The 19th is three days after the promotion started. It seems Secure Parking thinks that their responses aren't getting shared and they can make up whatever they want.

      They seem to be ignoring emails so it's fine. I guess 3 business days without a reply should warrant giving them necessary time to formulate a reply but they chose not to.

    Going to lodge a complain to the ACCC now. Considering to lodge a complaint to NCAT. Benefit is that they'll definitely take action if we're in the right (i.e look at the case), but downside is there's a fee involved.

    Really considering applying to NCAT, since they'll issue an official notice to Secure Parking then hold a court hearing should Secure Parking not reply to NCAT or refuse to take any actions. I just hate the feelings that companies are taking advantage of consumers because these companies think consumers wouldn't exercise their rights even when they're being taken advantage of.

    I've given them sufficient leeway to rectify the error but they just chose to ignore the issues or even bother giving a reply.

        From what I recall, it should be $49. It's not all about the cost, but also the fact that if they refuse to do anything after official notice is given, there'll be a tribunal hearing where I'll need to present my evidence against them and vice versa. So I'll have to make time to attend the hearing too.

        But on the bright side, if I am awarded the case, this would basically open the doors for everyone to do exactly the same as this would set the precedence. Everyone would then be able to obtain compensation.

        If I am really going to apply for NCAT, I'll be sure to request for damages more than the promised vouchers, for all the inconvenience and everything they'd put us through.

      Thanks for your effort in finding these, and I would be more than willing to support New Balance by paying them the difference even if I want the items you listed. However, won't be making anymore purchases or bookings with Secure Parking or New Balance till this issue is settled. They've completely obliterated my trust.

    Here are some numbers,

    New Balance's range is about 1000 items.
    Out of that 1000, about 400 are on sale excluding them from use of the voucher.
    Out of that 600, close to 400 are not foot wear only.
    leaving a bit over 200 of items that can actually be used with the code, roughly 20%

    On 10th August 2017, Secure Parking Pty Ltd (Secure Parking) ran a promotion were if a customer booked a car bay between the dates 16/08/17 and 31/08/17, each customer will receive per booking a "$50 off New Balance promotion code for use when shopping online with New Balance".

    The Terms and Conditions of this promotion only stated the following points (note there is no mention of the terms being subject to change):
    "*New Balance promotion code expires 31/12/17.

    *Offer only available online through www.newbalance.com.au"

    After receiving the New Balance code, Secure Parking have changed the Terms and Conditions to include "Footwear only." I have not agreed with this change to the T&C, yet they have proceeded to limit the voucher with this change. This heavily restricts the usage of the voucher. As an example, about 40% of items are on sale and excluded from the coupon (as was always the case), but due to the recent addition of 'footwear only' this reduced the number from 60% to a little over 20% of items that the coupon can be used on.

    I have tried contacting Secure Parking multiple times, but they either ignore me completely or respond that the T&C state 'footwear only' which is why I can't make my purchase.

    I am happy to provide any correspondence you require, for now I have attached screenshots of the changed T&C.

    In fact, I think a similar complaint should also be written to the ACCC regarding New Balance because it's a joint promotion and also because New Balance is the actual entity that changed the system 'code' to change the effects of these coupons.

    I've written in to New Balance and they were unwilling to help out with the matter. So I recommend for those writing to ACCC, you could bring in New Balance as well. 1) This would mean more entries overall to boost the probability of them taking notice. 2) As consumers, we won't know who were the actual ones that 'changed' the terms and condition because for all you know it might have been New Balance that told Secure Parking to effect this change.

      Whilst New Balance issued the codes to Secure Parking, who issued them to us, we didn't receive them from New Balance, the agreement and dispute is between us and Secure Parking.

      my complaint with New Balance would be manipulating the sale prices to limit as many items from the use of the vouchers, but I can't prove that yet.

    Fair trading will take action on a single complaint. I know this from experience in WA, over ten years ago. I'm going to write to secure parking now tha I'm back in Oz. I think I'll send them a certified letter, providing I can find an address. Imagine dealing with four or five fair trading organisations. They do have the ability to take cases to the state tribunal. 😀 Don't fight city hall. The government has lawyers on standby.

      No, I tried to buy some full price socks today, the code only applied for free shipping.I sent them the screenshot, they replied that the code only works on full priced footwear. Then I asked them when socks are not footwear? I have sent email twice, but no answer.

  • great work posting all of this mate! Just a note to other adults without kids - the only valid option are the slippers. got a pair for 0 dollars. Great deal. Spent $2.5, got $30 slippers delivered. Cheers, I needed a new pair!

      Not really the only option. Fir many the only option acceptable is to press for what was bargained for.

      • Depends on how much time you have and willingness to spend effort on it. To each his own.
        I am happy with getting $30 slippers delivered for $2.5 and luckily needed a new pair since I have been wearing old ones for more than a decade.
        I will still keep the old ones to wear in the house and these ones outside during summer. And 33 degrees now in Sydney. Perfect timing.

          I don't need any shoes or sandals, not that they offer female sandals anyway. A deal is a deal. An offer or invitation to treat was made and accepted. A contract. They have breached it. Glad you got what you bargained for. Good luck. 😀

  • So they cancelled the order for slippers saying they were out of stock.

    • dodgy. you able to get your voucher back?

      • I don't want the voucher back. What do I do with it. I want the slippers. I told them on the phone if they don't offer appropriate replacement for those slippers I am complaining to ACCC and NSW Fair Trading. They cannot accept the order, process it and cancel it without offering a suitable replacement.

      So dodgy, this is just getting worse. Wish that everyone here could know how misleading and deceitful these businesses are and get them banned on ozb

      • So they sent me the NB terms and conditions in which it is specified they can cancel any order anytime for any reason.
