  • another reneged deal, just received an email stating that this is now a Fitness First only offer so you have to have a valid fitness first membership. Hmm. That wasn't in the survey! oh well.

    If this wasn't listed on survey as a requirement then this is deceptive and misleading conduct to get hold of your personal details.

    Consider lodging complaint with ACCC.

      "Hi there,

      As I recall when I filled out the survey form, there was absolutely no requirement that I had to be a Fitness First member to receive the free gym towel.

      To me, this seems like misleading and deceptive conduct, and unless a towel is sent, I'll be contacting the ACCC with my concerns.

      Don't back out of a promotion upon which you have no intention of following through.

    Just received an e mail from Cetaphil saying I need to prove my membership of Fitness First to receive my free towel.
    I am pretty sure that there was no mention of that in the original offer, (which has now been taken down).

      "There seems to be a mistake here.
      I entered a survey to obtain this free towel.
      It was nothing to do with Fitness first.
      This seems like misleading and deceptive conduct, and unless a towel is sent, I'll be contacting the ACCC with my concerns.

    This is definitely deceptive and sneaky. if they intended to target the survey, they would have the membership number requirement as question No 1, other than the ugly "validation" afterwards.

    Also just received a ridiculous email requiring a Fitness First membership, this was not mentioned in the survey and I told them I still expect my towel as promoted and promised since I gave them my personal details in good faith.

      They are here [1] but I suspect that they modified them after the survey went viral. Can someone please go to WayBackMachine and put in this [2] URL. It's blocked at my work. Hopefully we can show that there were not T&Cs prior to it going viral.

    They have a mirror of the webform here, and it clearly shows that there is no Fitness First requirement stated. I attached a screenshot to my reply.

        I'm sure the branding cost of Cetaphil is more valuable than the 11000 gym towel if indeed they added the FF membership as a condition to the original T&C after the initial survey promo. Not very wise. They could have easily use this to their corporate branding advantage.

      My 2 cents worth:
      While the webform is definitely misleading, the clause Terms & Conditions apply would protect them unless we have proof that the original T&C did not stipulate FF membership as a requirement. Their back paddling on 31/08/2017 requesting to remove the post from ozbargain site was already the first sign that they realised their mistake and started thinking how to get out of the mess they created.

      Instead of shipping the free towel to meet delivery within 2 weeks, they took 3 weeks to strategise (probably including consulting legal advice) and execute this latest action on requesting for FF membership. I'm not too hopeful that they would ship the gym towel with just an email reply to them as they are well aware that once they set the precedent, they would have to be prepared to ship the towel to the rest of ozbargainers who filled in the survey. Nevertheless, worthy of a try and see how they would respond.

        The should have pulled the form when the stock limited was reached. Hardly difficult to code. all T&Cs should have been visible via the registration page. Poorly thought through promotion.

    Whether it's targeted would also depend on where and how op got the link.

    Was the link publically accessible on their webpage, or was op sent a link to submit the survey, is op a fitness first member, what did the email say?

      I found the mirror link using Google, so I would venture that the original link was similarly discoverable.

    It would have been nice if you made it clear that the free towel was just for Fitness First members before you collected people's personal details. This is dodgy and unethical. I'll unsubscribe from this list, and please don't send me any more emails re this or anything else.

    • We know Fitness First are dodgy with their membership T&C practices so it seems companies that associate with them are following them too! ;-)

      Having said that they are silly to miss out on the opportunity to market their brand to others for little extra cost even if they stuffed up with running the promotion. No idea who advises them but they seem to have made another bad mistake with the way they are handling this.

      Way to tarnish the Cetaphil brand. Maybe they want to be a case study for business school courses.

      • I honestly doubt this "deal" tarnished their brand. Most people buy their brand because they have to due to their skin conditions and affordable price. Their products are recommended by users in pretty much on every skin care beauty forum. A towel isn't going to make people (especially ozb users) try their products, samples will.

    Been looking for a reason to switch from Cetaphil and now I have. Competitors have a cheaper, natural, nice smelling (but not perfumed) product that works just as well for sensitive skin. Will be recommending to family & friends.

    You don't suck up my personal info with empty promises like that. Thanks Cetaphil.

    After badgering them on social media I received a towel through TOLL Express today.

    Fight the good fight, ladies and gents.

    My last message:

    "Yes, while you might have shared the link with a select group, it was also released into the public domain. That’s the risk you run. The form is also identical to the one used in Australia, so let’s not beat around the bush.

    As I said, there was no indication that one was required to be a Fitness First member to receive the free towel. I fulfilled my contractual obligations and you have not.

    I honestly don’t mind pursuing this further as I simply have the time and can be bothered. Dodgy promotions like this are rife and companies should be held to account.
