Should eBay Pay for My Restocking Fee?

Hi Ozbargain I'm not to sure if this belongs in the 'financial' section of the forum, i didn't know where else to put it.

So my situation started off with this deal: https://www.ozbargain.com.au/node/198554

I first saw it in the evening but unfortunately it was pulled early and roughly around 6:00AM it came back. I first tested it to make sure it worked with roughly 3 items in my cart and it provided me with roughly $80 discount. I proceeded to add more contents to the cart but when i went to checkout again with the voucher, the voucher was pulled. I spoke to a eBay representative on the online chat who advised me to purchase the item now and email eBay about reimbursing me with the 20% discount. Which i followed to do so.

eBay obviously declined the offer and said it was UK deal only even though i told them reports of users in America and Australia were able to claim the discount. So in the end i was forced to pay full price. Because of discount rejection i wanted to return the a specific item i bought but the seller said that i would only get a partial refund as a $25 restocking fee would be needed.

I believe eBay should reimburse me the $25 restocking fee as the eBay representative advised me to in order to get the 20% discount.

What are your thoughts?

    No the T/C said UK only.

    The CSO was obviously presuming you had read them and were therefore from the UK.

      Is the T/C still valid though if the discount was working for people outside of UK?

      The CSO did state it was for UK only at the start of the chat, but towards the end of it they say to buy anyways and email. (I should've mentioned that)

      I can message you the transcript if you'd like to get a better grasp on the whole situation

      • I will have a look if you want.

      • Yes, the terms and conditions would still be valid. Why wouldn't they?

        • I dunno to me just kinda seems pointless if they didn't even follow it the first and second time the coupon came back

          @rakkihizoku:
          just because you found a loophole, it doesn't mean the T&Cs are no longer valid.

  • Did you open it at all? Honestly, if you're willing to pay for shipping back I don't see why someone would force a restocking fee if it's unopened. You get your eBay and Paypal fees back anyway.

    • Still in its original box + the box it was shipped in.

      I guess $25 for labor to put it back on the shelf only logical reason i can think of

      • I personally find it unreasonable. I also sell on eBay and wouldn't care at all if someone was willing to pay for shipping back for an unopened return. $25 to pick the item from your doorstep seems a bit silly. Was that stated at all in the listing for the returns conditions? If it said 30 day returns, buyer pays for postage then I think you can argue your case. If it did say no returns maybe it's their discretion what their terms are.

        It's definitely not up to eBay to reimburse you the $25 - they have nothing to do with it. It's more the issue with the seller.

        • This is the item right here.

          Does state restocking fee..

          I agree the stocking fee is unjust but apart of their policy i guess. So can't really argue that.

          But its eBay that told me to buy it now. Maybe if they were like you definitely can't get the discount, but yet still bought it then i would understand.

        • @rakkihizoku:
          Yep you can't argue there, they stated the 20% fee, albeit hard to find that info.

          Do you have a screenshot of the transcript? I don't think they are obliged to follow through and I don't think anyone from Australia or America are going to get reimbursed once they find out they are not from the UK. You definitely won't get any sympathy from eBay for trying to bend the rules.

          Only thing you can do is try reason with the seller to cut down the fee. Since you have to pay for shipping + another $25, you may as well just keep it as you are spending an extra $40 now to send it back. It'd only be worth to return and buy it again only if the 15-20% off deal comes again and you're savings will be even less now that you blew $40 on it.

        • @BlazinPast: I've sent you a copy of the transcript, bit of a bore to read though haha.

          I told my mate about it and he bought something instantly i think he got the discount simultaneously. Probably double check on that.

          Luckily Paypal still has free return shipping! :D

          Think i've been through the whole of ebay department, paypal as well as my bank. Bank suggested as a last resort go to fair trade

          @rakkihizoku:
          Definitely can't go there as it was part of their terms and conditions. I don't think the aggressive route would work well. Try to reason with them more.

    Hi everyone! I would first like to thank everyone that commented and provided very helpful insight. I really appreciate everyone's input.

    In regards to the case eBay will be issuing a 20% credit for the item. So roughly $73 as the chat representative told me to purchase the item.

    • Nice! How'd you get them to budge?

        Just called in the morning and it's like they completely changed their mind on the whole thing. Was put on hold for awhile while they looked at all the transcripts and he said the promotions/refunds team will reimburse by Monday-Tuesday.
