      It said $32 on the PAYPAL screen… that's what I paid… my account shows a deduction of over $1000… surely that's pure fraud.

        The same thing happened to me… this is the last time I trust Harvey Norman. I have paid $15 dollars for an electric toothbrush before, so I assumed it was just a good deal. Now I'm down over a $1000

    • Mine showed $32 on the screen and somehow they have taken over a grand. I'm livid, they have cleaned me out ! The paypal email has also come through showing over a grand as well.

      I think "mismatch of information" will cover any pricing error. That's what a pricing error is.

    Update: I get an email informing the tooth brush is ready for collection. No email regarding cancellation or price error.

    • Did you get a separate emailed Tax invoice?

      • Invoice is issued after the transaction is complete - which means after picking up.

      • No tax invoice yet, I am still waiting for the cancellation email. Thinking to collect after work tonight if I did not get the cancellation email by then.

    • I got the same email saying my order is ready for collection. Went to store to pick up, met by store manager telling me that they have been told to hold all orders until their HO cancels all orders. No explanation on why I was sent the order ready for pick up email. I say call your store first before wasting your time going to store.

          I think HN should be ashamed to be screwing up on the price and making peoples make unnecessary trips to their outlets, if price error, then rectified immediately. I will wait for few more days in this case, when I have nothing to do then I will drop by the outlet to see whether they let me collect it.

          @stargalaxy: agree, mistakes happen but making people go in-store to be told its an error is ridiculous, they know its a error they should be on the phone or email immediately letting people know

  • HN play a shifty game IMHO. I noticed a Casio keyboard for $187 plus $25 for delivery, which made it the same price as JBHF's ($213). They removed it from their website, and the lower model (identical except for speed sensitive keys) which was $199 now comes up with $10 for delivery.

      Sure they can cancel an order, not sure if you get an order is finalized or ready to pick up that they can reneg.

      • Sale is not finalised until both goods & payment are transferred.

        I cancelled a HN order yesterday as I hadn't got around to picking it up. As no goods were transferred, HN refund my payment.

          That is what HN might say but it wouldn't pass in law.

          A contract of sale can be finalized before goods have passed and even before money has passed.

          I fully acknowledge that clicking on buy now and entering in paypal or credit card details is an offer, but I would argue once you get an email back saying order is ready to pickup or order has been dispatched would mean its finalized.

          HN let you change your mind due it a customer policy but they could of technically told you the goods are yours and even charge you storage if not collected in a reasonable time.

          Yes it's a complex area of law, especially for suppliers. Suppliers often define at what stage a sale has taken place & we need to agree to their t&c to proceed with purchase.

          Suppliers who sell on credit may define sale & ownership as passing to the buyer only after payment, although goods may transfer months earlier. If the buyer is unable to pay, they have a better chance to recover the goods.

          But we agreed to this business's process before clicking buy, which is that clicking on buy is only an offer, not a sale, and they can terminate the process for almost any reason.

          Online retailers usually have similar conditions, that are severely criticised when people have their orders cancelled after pricing errors. But we agreed to the t&c!

          Under consumer law, a merchant does not have to supply goods if there has been a pricing error. The ACCC states you should first check the company's t&c about this matter.

          Most of us only had 'order confirmed', just acknowledging our offer. There was no confirmation of sale!
          It is possibly different if you received a pick up or delivery notice. Once again it depends on the wording of the t&c we agreed to.

          I used those t&c to terminate my order before pick up, terminating the sale before it was completed.

          @Infidel: Yeah, but I would argue that once they accept your money (e.g. they deduct it from your paypal account) then the contract is complete. Their terms & conditions can't be enforced if it contravenes the law. Just like if I put a sign that syas "Trespasses will be shot", it doesn't mean I can legally shoot a trespasser.

          It's a complex legal argument on both sides, but IMHO HN should take some responsibiolity for their incompetences & even offer those who purchased the "pricing error" item some sort of store credit e.g. $8 credit for spending $50. It's good public relations, it gives them a monetary incentive not to continually make these human error mistakes (it's not a computer glitch, it's a human decision to price the product).

          Just the same as clicking a box saying you agree with a merchant's t&c - did anyone read them before clicking ;-) No, we want the deal.

          It's a forum topic in itself.

          HN (along with other merchants) does make these mistakes. They rely on t&c not read by far to eager bargain hunters, to deny the sale.

          Other businesses do offer vouchers etc in this situation. But as soon as you click on deal, Gerry knows it's those Professionals from OzBargain. So no sympathy for you.

          Simplest solution, just don't buy from HN.

      Although these words, "As such, we have not accepted your order", contradict the words in the when your order is ready for pickup previous email, "Order confirmation number:".

      They need to drop the word Confirmation from the email subject line and the Order "confirmation" number from the content. That way they they have a concrete out.

      I though I had a Acceptance/Agreement based on an email stating, "We'lll let you know when your order confirmation no is ready for pickup"

          Once your money is in the till at any bricks and mortar store, I'd call that a sale.

          In b&m store, you usually have the product in your hand, or a voucher or agreement to redeem product (e.g. food outlet where you may wait for product after payment) when you hand over the money.

          Generally, there is little distance (spacial or temporal) between you and the product.

          In a store, you should be informed before payment is accepted that there is a pricing error. ACCC has page about this.
          If a pricing error (over charge) is detected afterwards, you are entitled to a refund of the difference or even full refund for scanning errors.
          The store can not recover under payment for pricing errors after sale is completed.
          (HN once under charged me $250 in a $750 purchase & couldn't recover it after the sale was completed! The salesperson pleaded over the phone, but I knew all I had to do was say no.)
          A different situation to mass online sales process.

          That's why online is different. You ordered, payment was transferred, but t&c meant this was an offer, with refund of your money if transaction did not complete. It is usually a more distant transaction, governed by the merchants t&c you must agree to to begin the transaction. HN reserved the right to approve or reject all order offers.

          You're free to take on HN, raise with your local Office of Fair Trading or ACCC, but check their sites first to see if you're wasting your & their time. Usually the outcome they can achieve is a refund, which is coming.
          Still Jetstar is in trouble for not stating all costs up front, so you may win!

    Update: I just got the cancellation email, so HN is wasting everyone time again.

      I think it's pretty unfair to say HN is wasting everybody's time - we all knew our orders were probably going to be cancelled since it was obviously a pricing error at 97% off retail.

        If HN have better pricing check, this error should never happen and therefore none of us will have place the order. Source of problems lies with HN, we are just trying to take advantage of it. No error at first place, no wasting time for all of us. I suspect HN may have done it on purpose to show more traffic to their websites.

        But I still gave it a go @$8 ;-)

        Just received cancellation of DS order for $12.20 DAB+ radio, minutes after HN cancellation.
        It's a f#@king capitalist CONSPIRACY!! :-) :-)

        Am now beating myself up for wasting my time again ;-)

      They expect that the ACCC and Fair Trading are going to take action against Harvey Norman for this false advertising, a full refund, the product for free and an apology while they go tell everyone how dodgy they are.

  • Whilst very community minded to post right away I'd probably opt to buy and collect the goods before posting what's clearly a price error.

    You've no chance if all of a sudden the site gets smashed by a bunch of buy happy gum tree sellers .

    At least someone actually gets it then…
