Moving Overseas but Involved in a Car Accident (Third Party Cover & Not at Fault). What Kind of Claims I Can Made?

Hi there, I am moving to oversea soon and have a buyer made a deposit already for buying my car.
got involved in a car accident while I was on my way to get a RWC done. I was waiting for the traffic light to turn right, a lady hit my car when she was revising from her house. at that time, I felt sour on my ribs.

Police and ambulance came, she admitted is her fault and I had a regular body check from a paramedic but did not go to a hospital.
I called my insurance company but they won't able to help because I bought third-party covers.
I've got an insurance's reference number from the lady and the mechanic shop is able to help me to claim the repair cost but I know the whole process probably take days or weeks to complete.
It is likely that I have to cancel the flight & buy a new ticket after the claim is done and lost the buyer & have to find a new buyer.

as this is my first time, I wondered if anyone knows what kind of claims I could make?
can I claim the charge of the cancellation of flight ticket and other costs may incur?
should I claim the ambulance charges from TAC or should I make all the claims together (besides the repairment claim) against that insurance company?

any opinions are appreciated, thank you!

  • how much is the car worth?

the only claim you can make is that the other person repairs your car

    everything else, you cannot claim

not correct, you can claim car hire fee while the car gets repaired.

incorrect, you can TRY and claim car hire fee

but that's not much good if the OP is overseas……

First off as many many people fail to understand TAC and 3rd party insurance aren’t the same thing. You can’t claim everything as one.

By all means look up what you can claim from the TAC but I doubt it would include ambulances. I hope you have a ambulance vic membership…

It is likely that I have to cancel the flight & buy a new ticket

Why? If the first place you go to can’t fix your car within a week or so , take it to another.

If the car is repairable, contact the buyer , explain the situation and offer them $200 off if they still want it.
Assure them it will be repaired properly etc.

How bad is the damage? Can you see If a dealer would buy it? Even if they offer you $1000 less. How much would cancelling and rebooking flights cost??

"By all means look up what you can claim from the TAC but I doubt it would include ambulances. I hope you have a ambulance vic membership…"

that is so backwards it's not funny…..

……if you are driving a car (in VIC at least) and you are injured, TAC pay for pretty much everything (apart from the first $600 or so). Ambos are covered at least. So WTF are you going to claim against the TAC, they are covering you…………..?

  • You can try and claim as much as you like. Getting it paid is highly unlikely, especially if you don't have time for a legal battle.

Typical insurance payout would be medical expenses, vehicle repair and hire of replacement vehicle and nothing more.

  • You can claim damage costs to the car, possible hire car (for the time the car is out), through the lady's third party property or comprehensive insurance.

You can claim medical expenses through the lady's third party personal insurance.

    You can't claim anything else
