No Warranty by eBay, on Items Sold on Their Platform

TLDR; Buyer beware - there is no warranty on items sold by ebay.

I understand ebay is just a platform for sellers and sellers have to (?) warranty items. Am just sharing my experience with a seller who unregistered.

Bought a phone charging cable 9 months ago and yesterday morning it just stopped working. The seller is no longer registered on ebay - so can't ask him to remedy this fault. Asked ebay for my options and they kept pushing me to take it up with paypal. Paypal says take it up with ebay (as its over 180 days). Ebay has asked me to piss off.

I was lucky it was just a phone charging cable - I'd be very pissed and out of options if this was an expensive purchase.

-Hi, I bought a charging cable from a seller less than 10 months ago - and now the cable doesn't charge my phone. I can provide photos that the cable is in pristine condition - just doesn't charge my phone any more (tried my neighbours cable and that works)
-Now, I see that the seller is no longer listed on ebay : This user is no longer registered on eBay
-What do I need to do to remedy this defect ?
-Certainly a charging cable should last more than 9 months !
-ORDER NUMBER 000000000000-1978600111000
I am sorry to learn that the item is not working now. Let me share that under eBay Money Back Guarantee a buyer can claim for their refund within 30 days from the date of delivery. And in such cases we advise our buyers to contact their seller to get the issue resolved, you can get in touch with your payment service provider and check with them the possible outcome. In this case as the seller is no longer registered on eBay, I would suggest you to get in touch with your payment service provider like bank as we have seen previously that our buyers were able to get their issue resolved through them.

-also please note that I can dispute a paypal payment within 6 months. Since this transaction is at the 9 month mark, I can't dispute this payment. This puts me in a weird position. I have ordered a cable which isn't fit for purpose and the seller is no longer registered.
I understand your concern ,however as you purchased the item on feb 2020 , Please allow me to inform you that, transactions are covered under eBay Money Back Guarantee for 30 days from estimated date of delivery. Here as this was missed this time and I want this to be settled for you as early as possible, this is the only reason we are requesting you to check with your payment source and look for the possibility get yoyur refund through them, If you have made the payment via PayPalyou can check with them
Shikha
-Did you even bother to read my previous communication ?
-I have clearly told you : also please note that I can dispute a paypal payment within 6 months. Since this transaction is at the 9 month mark, I can't dispute this payment.
-I don't think you are understanding what I am saying, Is there a supervisor I can chat with?
-I apologies for the above miscommunication , however here in this situation this is the best posusel resolution , here you can also try to communicate with your seller
Shikha
I can get you over to a supervisor to speak about your situation. However,I really wanted another chance to be your advocate today. This is something I am very familiar with and can confidently explain best practices, next steps and even some possible outcome.
Shikha
-I dont think so. As you clearly haven't even looked at my text messages. The seller is no longer registered on your platform !!
-You wouldn't be a good advocate for me as you haven't even read what I am saying. I think a supervisor is what I am after.
-thanks

-I have checked with them. And since its past 6 months, I can't report this payment
Oh! I'm really sorry. In that case, eBay won't be able to intervene in this transaction.
Aakanksha
-Why not?
As it is out of eMBG period that is it has been past 30 days due to which eBay won't be able to take any actions from ttheir end.
Aakanksha
-What about honoring the Australian Consumer Law?
Australian buyers may have rights under Australian Consumer Law. Buyers should visit the following websites for more information: Australian Competition & Consumer Commission - www.accc.gov.au Australian Consumer Law - www.consumerlaw.gov.au
Aakanksha
-Very insightful. Thanks
-Are you atleast able to refund the coupon/discount I lost while purchasing this shabby product?
I'm really very sorry, we won't be able to offer any discount or promotion. Has it been within 30 days we could have helped you with a coupon. However, now, system won't allow us to take any actions from our end.
Aakanksha
-So, is it safe to assume that there is no warranty provided on items sold on ebay?
eBay do not provide any warranty. Warranty comes up with the product with which only seller can help.
Aakanksha
-cheers
-…and clearly if the seller is no longer registered, then I am stuffed
We certainly do not want you to be upset and feel that way. Rest assure, had it been possible, I wouldn't have given a second thought.

    It's a marketplace, not a seller.

    • Yea.. so is amazon. They seem to be much more on top of things.

      • Amazon also do the marketplace thing but I wouldn't trust it for major purchases either.

  • +8

It's not a perfect metaphor but this is like going to the owner of a shopping centre when a single shop closes. It's a risk no matter where you buy things from.

    • Yeah. Live and learn

      • +1

So what did you learn? Don't buy things from shops that might close?

Bought a phone charging cable 9 months ago

After 9 months of use, you want warranty on a cable that was sold by a random seller on eBay? How much was this cable?

    • +5

      How much was this cable?

      $1.99

  • +9

You really wanted a refund for a cable after 9 months?

Do you take your thongs back to Kmart after they bust a plugga?

  • +4

It's a phone cable via a random on ebay. They break. Just move on.

    • +1

      But ACL

      • +2

Anterior cruciate ligament? Did OP trip over the cable?

  • +3

Have you thought about taking this to the Supreme Court ?

    • +1

Take it all the way to the full bench of the high court.

      • Because it's a constitutional challenge

  • +2

Errr even in local Australia some cheap cable would only have 120 days warranty.

  • So….. the seller is not available anymore, and Ebay have stated that their warranty is only 30 days after purchase.

Your post title is that EBAY won't warranty your item, but they actually would. As per their information, if there is issue within 30 days, they'll deal with it. You're well outside that period now.

I guess it was worth a shot for you to cause hassle and hope that the cost of replacing would be less than the time you took of them etc. And when you can't get what you want, go bad mouth to others….

My condolences for your loss Karen.

  • 9 months on a phone cable and you're chasing it up…?! Damn, how much is your time worth?! I've had supposedly unbreakable cables with 2-3yr warranties break, yet I'm still not gonna bother claiming on a ~$7 cable

  • Listen, altho i do think this is a troll post, i thank you for the community announcement. I will bookmark your post for future reference for what to consider the next time i use my hard earn cash on phone cables.

It amuses me to think the now unregistered seller may have been China or HK based - and OP is spouting about ACL.

  • 9 months, i stopped reading right there

  • +4

    Oh….you're one of those people…
    :/

    • Yup. If you're going to say the magic words ACL/ACCC etc, at least do your homework and know what your actual entitlements.

Are you aware that the time you have wasted arguing with ebay, paypal and now trowing a tanty here over that and making us read that novel has probably costed more than just buying a new cable?
