JD Sports Dealing with Return Due to Their Fault

My wife purchased some airforce one shoes at a JD store a few weeks ago. When she was at the register the staff member insisted that she purchase a size 9, after she had already determined that 9 1/2 was the correct size in a different color. My wife made it very clear that size 9 was too small and that she needed a 9 1/2.

They didn’t have stock so they had to be ordered in. Being unfamiliar with their setup she paid the $10 delivery fee to get the shoes, but was unaware that they were to be posted from the UK.

Anyway after getting home she realised that the staff member had ordered a size 9. Furious she contacted JD who said to return the item when it arrived.

It’s finally arrived today and the box was damaged in transit. Their policy states no returns with a smashed box, and they take no responsibility for goods damaged in transit. Surely this does not meet Australia consumer law?

Any advice on how to tackle this one most appreciated. I’m expecting all out warfare when we go to return this item.

      UK and AU sizing are the same. US is one size bigger.

      • For women's shoes AU and US are the ones which are the same.

  • Is the return back through the post system or return being done in the store? If it's back to the sender, then the damage occurred on the 'return' trip :p

    If it's back to the shop, I'd simply be going back to the shop and stating that's how it arrived regardless of what their policy says. They may just accept the return, but based on the info so far, I am guessing you're making the post based on what you've read. It may be the case that they refuse, but still, there's potentially more to be gained from discussing the issue with the store (if this is how returns are done) then online.

  • If you're buying it from a store why on earth would you pay a delivery fee at all? If you're buying online, you would have been able to choose the size yourself. Regardless, orders can be returned to the store in their original condition. If they arrived with a smashed box, that is the original condition you received it in. I wouldn't assume its going to be a problem. Just try, it should work out fine. If they cause a fuss then think about other options like a charge back.
