Does your pet want to be famous? We are searching for Australia’s superstar pets! We have 2 $500 Kmart Australia e-vouchers to give away. Plus, for 2 weeks, each week, 10 weekly finalists will win a $50 Kmart Australia e-voucher.

1. Information on how to enter and the prizes form part of these conditions of entry. Entry into the Promotion is deemed acceptance of these terms and conditions of entry.

2. The Promoter is Kmart Australia Limited (ABN 73 004 700 485), 690 Springvale Rd, Mulgrave, VIC 3170.

Duration

1. The Promotion commences at 12:01am (AEDT) on Thursday 4th April 2024 and closes at 11:59pm (AEDT) on Wednesday 17th April 2024 (“Promotion Period”).

Eligibility to Enter

1. Entry is open to Australian residents who are 13 years or older. Employees (and their immediate family members) of the Promoter and its other related companies are not eligible to enter. ‘Immediate family member’ means a spouse, ex-spouse, de-facto spouse, child or step-child, parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

2. Eligible entrants under the age of 18 must have permission from a parent or legal guardian to enter the Promotion.

Entry Mechanism

1. This is a game of skill competition.

2. To enter, eligible entrants must do the following:

a. log into their personal Instagram, Facebook or TikTok account and follow Kmart Australia and ensure their profile is set to public.

b. on their Instagram, Facebook or TikTok page, share a photo or video of their pet, along with a comment, telling us why their pet is a superstar.

c. on the above post, use the hashtag #kmartlovespets and tag Kmart using the relevant social media platform handle, on Instagram use @KmartAus, on Facebook use @KmartAustralia, on Tiktok use @KmartAustralia.

1. Entries must be submitted during the Promotion Period. The Promoter is not responsible for any lost, late or misdirected entries due to technical disruption, network congestion or for any other reason.

2. Multiple entries are allowed and each entry will be judged in isolation. Use of automated entry software, spamming or similar is not allowed and will result in all entries by that person being invalid.

3. The time of entry will be deemed to be the time the entry is received by the Promoter.

4. Each entrant warrants that the entrant will not upload or submit content that contains or promotes sexually explicit material, hateful, defamatory or discriminatory material, any material depicting or promoting animal cruelty or any content that in the opinion of the Promoter would cause harm to its business interests or reputation, portray the Promoter in a negative manner or is otherwise contrary to the law.

5. All entries (photos, videos and comments) must be original work owned by the person submitting the entry. Each entrant warrants that the entrant owns all intellectual property rights in the post that the entrant submits in connection with the Promotion (other than intellectual property rights owned by the Promoter).

6. All entries become the property of the Promoter.

7. The Promoter reserves the right, at any time, to:

a. request that an entrant verify the validity of their entries and the eligibility of the entrant (including an entrant's identity, age and place of residence)

b. disqualify any entrant who tampers with the entry process

c. approve or reject any or all entries at their discretion

1. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Prize Details

1. Every week for two weeks there will be 10 x weekly finalists chosen. Being a total of 20 weekly finalists across the Promotion Period. Each weekly finalist’s prize will be a $50 Kmart Australia e-voucher. T&Cs of Kmart e-vouchers are available here https://www.kmart.com.au/gift-card/

2. At the end of the Promotion there will be 2 x overall winners selected from the 20 weekly finalists. The 2 overall winners’ prizes will be a $500 Kmart Australia e-voucher.

3. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting a prize that the winner accepts the conditions of use of that prize.

4. The Prize must be taken as offered and cannot be varied.

5. The Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained in connection with the Prize or redemption of the Prize, except for any liability which cannot be excluded by any applicable Australian law (in which case, that liability is limited to the maximum allowable by law).

Selection of finalists, winners and redemption of prizes

1. The weekly finalists will be selected and announced on the following dates:

10 weekly finalists will be selected on Monday 8th April 2024 and announced on Saturday 13th April 2024.

10 weekly finalists will be selected on Monday 15th April 2024 and announced on Saturday 20th April 2024.

The 2 overall winners will be selected on Thursday 17th April 2024 and they will be announced-on Monday 22nd April 2024.

1. Entries will be judged based on originality, creativity, pet cuteness, photogenic ability, unique talents and the description provided. Bonus points for inclusion of Kmart pet products!

2. All finalists and winners will be selected by a panel of 4 judges who work for the Promoter. The judges will have absolute discretion to choose the winning entries, and the judges’ decisions are final. No correspondence will be entered into in respect of any decision made in connection with this Promotion.

3. The finalists and winners will be notified via social media DM within three (3) business days of the selection. The Promoter will ask the finalists and winning entrants, via DM, to provide their name, email address and best contact number. If a finalists or winning entrant fails to provide their details to the Promoter within 48 hours of the Promoter sending the DM, then the Promoter may, acting in its absolute discretion:

a. make further attempts to contact the entrant; or

b. withdraw the prize from that finalists or winner.

1. If a prize is declined by a finalist or winning entrant, or withdrawn by the Promoter under these terms and conditions, that entrant will still be bound by these terms and conditions and the Promoter shall offer the prize to a different entrant selected by the judges.

2. The finalists and winners will be announced via Kmart’s Facebook (@kmartaustralia) and Instagram (@KmartAus) social media channels and website https://www.kmart.com.au/category/home-and-living/pets/. Finalists will be announced and contacted by Kmart only. Please be cautious of fake accounts.

Miscellaneous

1. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees and any implied warranties contained in the Commonwealth and applicable State and Territory consumer protection laws.

2. If for any reason the Promotion is not capable of running as planned, including due to any computer virus, technical issues or any other issues beyond the control of the Promoter, the Promoter reserves the right to discontinue the Promotion.

Entry Details and Privacy

1. Any personal information provided by entrants to the Promoter in the course of entering the Promotion will be dealt with by the Promoter in accordance with these terms and conditions and the Promoter’s Privacy Policy (which is located at https://www.kmart.com.au/privacy-policy/)

2. Entrants’ personal information will be used for the purposes of conducting the Promotion, redeeming the prizes and any other matter connected with or incidental to the Promotion. All entrants’ personal information may also be used for distributing communications and marketing materials and event information in the future.

3. Each entrant agrees that the Promoter may publish or cause to be published the finalists and winners’ name, social media username, entry and locality (Suburb and State) in any media or as required by law.

4. Each entrant agrees that the Promoter may publish or cause to be published the entrants name, Instagram social media username and entry in marketing materials such as social media posts and Kmails.

5. Neither Facebook, Tik Tok nor Instagram sponsor, endorse or administer the Promotion. Any questions or comments in relation to the Promotion are to be directed to the Promoter and not Facebook, TikTok or Instagram.

6. The Promoter reserves the right to amend these terms and conditions at any time if it has reasonable grounds for doing so. Any changes to these terms and conditions will be announced by the Promoter through its Facebook, TikTok and Instagram accounts.
