Notice of 30 Days to Disconnect Home Phone + Internet (VIC)

My current contract with my existing ISP (Spintel) ends on 2nd June. I called them to know about the cancellation charges if I want to end it now. They told me that I am required to give them a 30 day notice if I don't want to continue with them or else there will be a disconnection fee.

And this notice has to be after my contract ends. So, I can't give them a notice on say, May 2, to end my contract at June 2. I can only give that notice on June 2 (to avoid cancellation charges) and then they will still charge me till July 2. I can however move on to another provider starting from June 3 but I will be charged the normal monthly rate by Spintel for the month of June.

Is this true? Doesn't this mean that this was a 25 months contract instead of 24? Am I legally obliged to give them this notice?

  • Ask for this in Writing then check with TIO.

Is that what they said or is this your reading?

    • That is what they said.

      • That seems to make their claim of a 24 month contract misleading. In your place I would dispute it.

  • You're switching internet providers because Spintel internet always drops out and you're unhappy with their service. The contract means nothing because the service you are getting isn't up to standard.

There's no point playing fair with ISP and Phone companies, because they don't either.

i would think not. you should be able to give notice before the last month so that all billing stops on the last day your contract or billing period.

however, the first thing to do is read the terms and conditions of your contract from their website regarding cancellations.

  • You are lucky. I spent 40 minutes on the phone and no one can help.
