Item lost or damaged during Aus Post transit

Who is responsible if the item is lost or damaged during transit?

Payment is paid via paypal.

I purchased an NFC tag from cpl last week and they sent it via standard mail.
I received a damaged envelope wrapped using Aus Post's plastic sachet with nothing on it.

Its only $0.77 but I didn't get what I purchased.

I tried talking to cpl but their responses so far are "There’s nothing much more we can do", "We really are unable to help with this situation.", etc

I believe it is the seller's responsibility to ensure that the buyer receive the goods in the condition advertised. Correct?

  • From my understanding, contractually once the goods have been sent from the supplier that's about it (unless personally delivering through internal logistics)… so long as you've agreed to the shipping terms (with/without insurance, with/without signature, with/without tracking) the seller wouldn't be responsible.

    Not sure on Paypal's protection in regards to this but it sounds like you'll have to chase it up with Aus Post (sincerely good luck)

    The option of postage insurance should be available at purchase with online stores…

    Its a tough one, but how can the buyer be responsible for how Australia Post treats the mail.

    or maybe a kid going past anfd going through your mail.

    Hmm did the item qualify for PayPal Buyer Protection? If so according to PayPal it is their responsibility:

    13.7 SNAD Definition
    What is Significantly Not as Described (SNAD)?
    An item is Significantly Not as Described if it is materially different than what the seller described in the item listing. Here are some examples:
    You received a completely different item. Example: You purchased a book and received a DVD or an empty box.
    The condition of the item was misrepresented. Example: The listing said "new" and the item was used.
    The item was advertised as authentic but is not authentic.
    The item is missing major parts or features which were not disclosed in the listing.
    You purchased three items from a seller but only received two.
    The item was damaged during shipment.

    • Fudge. This applies to my eBay case as well.
      What happens when the buyer opens a computer after receiving it not as described? Naturally it would void the warranty or guarantee… right?

      But in your case… it appears CPL should be issuing you another one or a refund. Although… its only 77c! I wouldn't bother kicking up a racket about 77c.

  • According to Consumer Affairs Victoria and the Postal Industry Ombudsman, the liability for delivery lies with the carrier once it has been dispatched and if an item is not delivered then the buyer needs to make a claim for compensation.

    I would think it's the same thing with damaged items but for me when I am selling, I don't put much packaging on my items so sometimes they do arrive damaged (99.9% of the time they are find though) and so if I am given proof of damage I just send out another one. It's only fair seeing as the lesser packaging is saving on costs.

      I think it was your service.. I received two cables from you that were damaged .__.

      It only costed $3 so I didn't bother complaining.

        • I'm still not sure what the issue was. If they arrived damaged and you still have them and can send a photo I will replace them. I'm still not sure what you mean by "I think it was your service"

        • Yeah don't worry, I didn't bother complaining or anything since it was pretty cheap. But I'm just saying that the packaging service could have been better?

          I said I think it was your service because I couldn't remember who I bought them from. But if that address that I did post was yours… then it was from you.

          It is but I run it from home.

          I didn't see the address though. So you may well have bought it from me.

          I understand my packaging policy might not satisfy some people but I do replace them if a photo is sent.

          The reason for it being that if you use any kind of padding it generally will put it over 20mm thick and then you pay $6.95, no matter how small it is otherwise. So it saves everyone money and if there is damage I sort it out when advised of it.
