[VIC] Loading zones

Hi all,

Are you allowed to park in a loading zone outside of the designated times on the sign? For example, if the loading zone time says 9am-6pm, are you allowed to park for 2hrs from 7pm-9pm? The zones on either side of it were no standing zones and I believe a lady got booked by council officers because she was parked behind me in the no standing zone. I think I heard the council officer say that her car and the car in front (my car) are receiving fines. I didn't get the chance to confront them.

I always thought the zone becomes a normal unrestricted parking spot after hours. Was I parking illegally?

    Doesn't specially answer your question but implies you are OK, as long as no other sign covered that area.

    • Oh thanks Bruce. I had a look on their website but could not find any specific information. I'll have a look at that pdf.

  • Cant see a problem parking after 6pm - it's not rush hour.

  • i was most likely a no standing zone with loading vehicles permitted to park from 9 am to 6 pm. no parking after the said times for any vehicles.

    • If that is the case, wouldn't the no standing zones sign directions include the loading zone? If I'm not mistaken, there were two no standing signs on either side of the loading zones pointing away from the loading zone. I wouldn't have knowingly parked in a no standing zone.

      I've been parking there every now and then for 2+ years and never received a fine. However, this is the first time I've seen council officers there that late (around 8pm). I'll double check the sign tomorrow. Guess I'll just wait and see if I receive a fine or not.

        No need to check.

        If the sign says loading zone 9am -5pm then you must have a vehicle which is permitted to use a loading zone and stay only as long as permitted.

        If it says nothing else then outside those times you can use any vehicle and park 5pm - 9am for the whole time if you wish (But miss it by a minute and they can get you)

        If there are any restrictions outside the loading zone time displayed, these must also be displayed.

        Examples

        No stopping 5pm to 9am (or "no stopping at other times")

        or maybe a clearway restriction (often on another sign above)

        or maybe 2 hour parking 5pm - 10pm

        There are many other examples, but the point is these need to be explained on the sign, otherwise no restrictions apply other than any "standard" road rules - eg Distance from intersection, fire hydrant, postbox etc

        • Thanks. I confirmed that there were no other signs or conditions within the loading zone besides the 9am-6pm loading restriction. I'll be annoyed if I get a fine.

          Generally also parking fines are issued on the spot.

          Fairly rare to get one posted to you, unless its something like you drove away while they were writing the ticket.

        • That's not true.

          Once I had to break within no standing zone as the road in front of me was blocked by parked cars on both sides and then another vehicle had stopped in middle of the road and loading kids after school. The last car in the allowed parking area was signalling to move out. So I slowly approached from the back of that car but all of a sudden she turned the signal off. At the same time traffic in middle got cleared so I moved forward and parked in front of that car in the allowed parking area. But a vehicle from Dande council was in the intersection and took a picture in the second when I had to break in the no standing area.

          As soon as they took the picture they flew off passing my vehicle. I tried to talk to them but they didn't even stop.

          I wrote to council later and they didn't accept that's it's unfair. As long as they have a picture that's it.

          This very morning when I went to drop my kid in school, as soon as I entered this street into no standing area, a guy was making 3 point U turn and I had to break as I can not hit that vehicle. Luckily council parking officers were not there. I just made sure their vehicle is not behind me as soon as I realized the guy is doing 3 point U-turn. I am still not sure if I should run into that vehicle in case if council Parking officer was there. I didn't even honk at him but I really wanted to talk to him and tell him that his legal U-turn can force someone to pay a penalty to council.

        • Hmmm yes. I believe I saw the officers taking photos of the car behind me. This was when I first noticed them. I was busy at the time so I could not keep my eye on them the entire time or approach them. However, in the time that I was observing, I didn't see them hand over anything written to the female. I assumed she (and I; if I was in the wrong) would be receiving it via mail.

        • This morning when I drove to school there was a line of vehicle in the 2 min stop area and the last 2 cars just started signalling to move out. But I no longer want to be the nice guy to break and let them leave and end up paying a fine to cheeky Dande council.
          So I just decided to go pass the no standing sign and then signaled to the left to take up a place bit further once another car started moving out. I saw both the drivers were giving me the angry look when they went past me after I parked. You can't be nice to people when council officers don't use the common sense to assess the situation but just look for the opportunities to earn money.

    I'm an engineer at a council in Victoria and in charge of some traffic signage.
    If there was no signage or restrictions covering your time of park, then the parking is unrestricted.

    From what you have outlined, you are fine to park there.
    The lady behind however is gonna cop it.

    If you do receive a fine (unlikely) then you have grounds to challenge - usually internally at first.
    However, I would make sure you get photos of the signage in the vicinity to confirm your position.
