Bought a rented product from Flexirent

Hey guys,

I think I made I mistake today, I want to know my position.

Was looking in eBay and found an item that close to my area and I was interesting on it. Contacted the seller and we agreed in a price with doing the transaction out of eBay so she saves eBay and PayPal fees and I got it cheaper.

I checked the item when I picked it up everything was perfect as she said and I took some photos of the receipt as she said she needs to photocopy it and will give it to me later.

When I got home I looked at the receipt and found she bought/ rented it from flexirent
I tried to look at the T&C of flexirent and saw she should return it after her term ended or offer them a price to keep it and she should not sell it.

I have all the SMS between her and me and photos of the ad and the receipt. So am I in big trouble ? Should I try to return it to her ? Or get rid off it ?

  • I am not sure how flexirent works, but I doubt you are in trouble.

    The seller on the other hand probably has some serious explaining to do - plus I'd imagine fees, penalties, balloon payments and interest to pay. I feel sorry for people who are obviously in a bit of financial trouble and end up getting themselves in more.

    If I were you I would call the seller and offer to reverse the sale (for her sake) knowing that she has probably just caused herself a heap of grief, on the other hand she may have used that money for food, petrol, drugs whatever by now so may not be able to unscramble the deal to save herself the future pain.

    Not a good situation from any angle but I doubt you will get into trouble, other than the guilt associated with the problems this poor woman now has.

    • I tried to contact her again asking her if she wants it back, she asked why? I told her about the problems she may has. She told me don't worry I will take car of everything, if I don't want She will sell it to somebody else.
      Basically both of us are students. She seems need some cash. And for me it's big saving buying from her. It's around $500 off the RRP price. And the item was new sealed

  • Maybe she bought it from flexirent after her contract ended. I'm pretty sure she is able to sell it if that is the case.

    Don't worry yourself.

    Flexirent keeps billing the customer until they return the goods to Flexirent (or the store). It is not like at the end of the term they stopped billing her and she sold it.

    Either she paid them to purchase it at the end of the term, or she is still paying.

    Either way, you don't need to worry.

      I will keep all the information I have in case if she report it stolen or anything

  • No, U r fine but the seller is in deep SH*T…
    the T&Cs are for the person who has rented the product from flexirent. they cannot and should not have sold it to u but u as a bonafide buyer obviously did not know that is is product from flexirent and assumed that the title is clear. make sure u keep all the communication between u and seller if flexirent people come looking for u… obviously for them to come for u they will have to do it through the person who rented it as they wont have ur details…. if the other person gives them your details, u can show the sale deal and contact police as the seller has commited a fraud selling u something which did not belong to them….

    • From the stories that I read, I feel sorry for her, it's like paying the twice the cost and don't own the item.
      I tried to offer her to return it if she wants to cancel the contract between flexirent and her but she told me she will be able to handle it,
      I am kind happy with the item saved $500 of RRP.

    I wouldn't say You are fine just yet.

    The person selling it, may not have title on the goods, therefore can't legally sell it.

    If flexirent come knocking on their door, and they say I sold it to msmhw, then you will get a visit.

    I myself have been caught out this way, in the end flexirent may own that TV.

    Yes the seller, will be in deep shit, but the TV will go back to the rightful owner ie flexirent.

    I hope for your sake, she has title.

    • Right now I am trying to save all the SMS And emails in case if something happen.
      I had bad experience once in gumtree, bought an iPhone 4 from him when it came out. After couple of weeks I got a call form the police that there is an iPhone activated under my name have reported stolen.
      After som calls I proofed to the police that I ought the phone from him, I don't know what they did with him after that but hate it was westing time and worry about what will happen

  • she prolly gets all these items on flexi rent and sells them, getting cash right away for small outlay
    she prolly either
    - leave the country
    - gamble it all at the casino

  • I'm trying to work out how she comes out ahead. I think djones145's suggestion is one possibility. Another is she rents items, sells them unopened, then claims she was burgled to get item replaced on insurance. Apart from those two scenarios, I can't think of another possibility.

    It would be different if the item were used - she may have just purchased it outright at the end of the rental contract. But brand new!?

  • Ring radio rentals and ask them. You don't have yo give your details or the sellers but voice your concern. See what they say.

  • I agree with altomic. give RR a call and raise the concern. That way you would be sure and there would be one less thing to worry about.

  • does she have anymore items for sale.. (may be all Ozbargianers can save some money and get brand new things at cheap prices)…

    i sold a phone and then paid my flexirent contract with the $

    all good.
