Refund policy -Chemist Warehouse

I purchased an omron brand digital thermometer for $70 from chemist warehouse. When I got it home it had an error code which the booklet indicated to return to store. I needed a thermometer so purchased another from my local chemist. I took the faulty thermometer back to chemist warehouse with the receipt expecting a refund. They said its up to the manufacturer to process refunds. They took the thermometer and my details and a copy of the receipt after I refused to give over the original and said omron would contact me. This was last Thursday and today a replacement thermometer has arrived in the mail. I don't want a replacement now as I purchased a new one the day this one didn't work. The chemist warehouse said they will not provide a refund. Has anyone had any experience dealing with them?

      If a product or service you buy fails to meet a guarantee, you have a right to a remedy such as:

      refund

      repair

      replacement or exchange

      compensation

      cancellation of contract.

      Minor failures to comply with a consumer guarantee can normally be fixed or resolved in a reasonable amount of time. In this case, the seller can choose to offer you a refund, replacement or repair or, in the case of services, resupply.

      If the seller refuses to fix the problem or takes too long, you may be able to get it fixed by someone else and recover the costs from the seller.
      Major failures
      Major problems cannot be fixed or are too difficult to fix.

      you would not have purchased the product if you had known about the problem. For example, you would not have bought the washing machine if you had known the motor would fail after three months.

      the product is significantly different from the description, sample or demonstration model you were shown. For example, you ordered a red bicycle from a catalogue but the bicycle delivered was green.

      the product is substantially unfit for its normal purpose and cannot easily be made fit within a reasonable time. For example, the raincoat you bought is not waterproof because it is made from the wrong material.

      the product is substantially unfit for a purpose that you told the supplier about, and cannot easily be made fit within a reasonable time. For example, you told the seller you needed a car to tow a boat, but the car they sold you is not powerful enough to tow your boat because its engine is too small.

      the product is unsafe. For example, the electric blanket has faulty wiring.

    It would fall under minor, Put it on facebook etc etc. I wouldn't of bought another one until Omron contacted me.

    Grey area, depends whether you think its a major or minor problem.

    • major problem if you would not have purchased the product if you had known about the problem.

      So Barry, would you have bought the thermometer knowing it was faulty ?

      If you answer 'No', then its a major problem
      Then it's within your rights to get a refund.

      Of course it's a major problem, the product dind't work at all!

    Go Direct to Omron - explain situation& ask for a consignment note to send back. I used to work for a Pharmacy group H.O. & they are all basically just sellers for the companies they promote. Whilst Chemist Warehouse should & could have honoured this faulty sale just now take it further to the actual company.Failing that the office of fair trading as it would seem you are within your rights.

    You're allowed to return the item within two weeks for any reason, according to the ACCC.

    Also, in-ear thermometers sell for $11-12 online
