nVidia included games expired

Hi Everybody,

Long time lurker, first time poster.

I assembled a new PC, having had my last one for 10 years. I wasnt really a gamer previously, but have amply equipped myself to get into it with an i7 4771, 16GBs ram and a Galaxy NVidia GTX770. I was quite pleased to find the box for the GPU promised 3 free games included - Assassan's Creed 4, Splinter Cell and Batman Arkham Origins. Being so out of touch I naively thought this meant 3 DVDs would be included, of course this is 2014 and what was included was 3 vouchers to download the games, all of which had already expired!

I stubbornly tried to redeem the vouchers anyway and managed to redeem AC4 and SC as it seems the redemption form is still online. However, following the links to Batman AO did not yield as positive a result:

Unfortunately this was the one I was most looking forward to trying.

I have a few questions:

  • The box expressly said that all 3 games were included, although of course with the obligatory "terms and conditions" apply in tiny print. Are there any protections under the Australian Consumer Law that would help me here? If so, who would I take it up with? mWave (who sold me the card)? Galaxy? nVidia?

  • Could I ask nVidia for help here - are they reasonable?

  • According to the official website for the GTX770, the card no longer comes with Batman AO but does come with "Metro: Last Light" along with AC4 and SC. So, has the retailer made an error and should they have give me a voucher for Metro: Last Light instead?

  • The 770's I think are about a year old. I'd say the bonus games were there to entice people to purchase the new tech. Like you said, it's in the fine print. I'd say you're pretty lucky to get the 2 you got. I think it's pretty rude, but that's business.

  • If Mwave said "includes 3 free games" in the store listing, take it up with them. You bought the card on the basis that all three games were included, false advertising, blah blah …

  • Yeah I did put a call in to the NSW Fair Trading people (I am Victorian but MWave being in NSW…), they seemed to think that the generic 'terms and conditions apply' statement would have covered them

  • I wish I got some vouchers when I bought my Nvidia card (my card was even eligible in the first place)…but nope, didn't get a single one.
