Guys need your Help with the child booster seat Law here in NSW.

I have never had a situation like this before but this time my nephew who is 7 years 4 months 27 days old is coming to Sydney. So, if I take a drive with him, do I actually need a child booster seat or not. I am bit confused because the Law says 4 to 7 years old needs booster seat with H-harness or a booster seat with a secured adult seatbelt. But my nephew he is more than 7. So I don't know what to do.. please help me with the possible reference.

Thanks in advance guys.

I'm pretty sure you'll be fine since Transport for NSW is quite explicit in saying under 7 years repeatedly not 7 years and under.

Instead of asking armchair lawyers here why not call your local police station? or Kids N Traffic for a definite answer.

  • Thanks heaps I will do that tomorrow.

  • also it recommended to sit kids in the back seat
If kids doesn't look like a seven year old, carry copy of their id, will save some time, in case you get pulled over

Legally you'd be fine not to have him in a booster BUT is he tall enough and mature enough to not NEED it to be kept safe?

In my experience, the police don't know the rules regarding child safety seats themselves a lot of the time. I had one tell me you HAVE to turn a child to forward facing at 6 months old.
