Bought a HTC One XL and got a HTC Sensation XL from eBay, best way to resolve this

Last week I bought a phone from eBay and received it in the post today.

It's partly my fault. The listing was a little confusing which I only now realised but the title said it was a HTC One XL. I was thinking I could get a bargain so I bought it quickly.

I did notice that it was a picture of a different phone, but it had 2 other pictures of a HTC One XL and I thought the first one was unrelated. I must admit I got a little excited by the price. But it had 2 other pictures, I'm sure of it. I cannot seem to get them now :/ Anyone have any ideas, ebay only seems to be showing the first picture. Or maybe I got confused with another listing (I do get confused easily).

I may not be able to do much, while they did make a big mistake with the title, and the other two images. It clearly has the word sensation in the description, I don't remember seeing that there at all but I know it's impossible for them to change it so it must have been there.

What made me sure it was a HTC One XL was that it said it has Telstra firmware in the description. It actually has Vodafone firmware which they did put in the title so it's confusing me.

They also listed it as new stock when it is indeed ex display stock and clearly has been used.

Any ideas if I should be eligible for a refund. I haven't contacted them yet but will soon. I hope they can also pay for postage back. My next problem is I'm unfit to leave the home so I cannot go to the post office but I guess that can be no excuse when using eBay as problems do arise, I can just get someone else to do it for me.

I was also not going to worry about it and wear it. But my sim card won't fit into this phone as it's Micro SIM, while I have an adapter it won't fit either and could break the contacts because of the phones poor sim tray design.

  • They should replace it and refund the money as it is not new it is display and used. They will not pay for return postage as that will be up to you, unless you declare that you did not get it, and if they posted it using a tracking number at the post office, that is pretty well impossible. I am hoping you paid by PayPal as you can open an item not as described dispute, but as far as I know you will be asked to return it and to scan a copy of the return receipt to PayPal and make sure you return it with tracking to prove they receive it. Then as far as I know you will get the refund less the original postage cost?? hope that helps.

        I'd definitely wouldn't have bought it with that conflicting information.

        • Problem is I didn't even realise, the only conflicting info I noticed was the picture but I'm sure there was two other pictures there. But I know it must have been like that. I'm just not very good at noticing things when buying in a rush in a bid to beat anyone else. I guess I just have to be more cautious in the future.

          The item had like over 32 people watching it. I should have wondered why no one had bought it already.

          I guess a lesson has been learned, hopefully I can get a refund. I sent the seller a message and I hope they are nice folks. Because I asked them to correct their mistake by offering me another one of their phones for $30 better price. But this phone I'm looking at to ask them to take $30 off has the same problem. The listing is a mess. There is a stock photo of a completely different phone and two photos of the phone that's in the title.

    A huge ebay seller like that will likely respond and try to fix their mistake, especially since they're an Australian based company. Definitely contact them to discuss. Most likely a data-entry person just typed things in wrongly.
