Consumer guarantee - repair/replace/refund timeframe?

Hi guys,

My Dyson vacuum died last week - the motor made some horrible grinding noises with thick black smoke pouring out the back. It was purchased from Myer in 2008 so six years old now. Dyson has a 2 year warranty so it's well and truly expired, and I've sent it to them for a no-obligation quote to repair, but haven't heard back yet.

I was looking at the ACCC's repair / replace / refund brochure and it says you can use your rights even after the warranty is expired. It doesn't seem to mention a timeframe though.

How long a timeframe would be considered reasonable or within my rights?

I've got a feeling if I took a 6 year old vacuum back to Myer asking for a refund/replacement they would start laughing in my face.

    If you feel they would laugh, it is probably a good indication it is outside the 'reasonable' time frame.
    I personally would expect to get more than 6 years out of a vacuum, but I can see the supplier's point of view too, as they don't know whether you have flogged it or mistreated it.
    Dysons are pretty easy to repair your self, there is a guy on youtube that has good videos of all steps:

      Although they haven't come back with the assessment yet, the rep said motor costs roughly $80 to replace on top of the $85 "service/inspection" fee. I'll probably just suck it up and pay as it is a fraction of what a brand new one costs.

      But then again, if it's well within my rights to return it to Myer then…

    I think that for the price (under $1000) you prob got what you paid for. Did you clean the filters at the required intervals, did you ever have renos done in your house while using the vacuum, did you ever fill the dirt bin past the full line? if you answer yes truthfully to any of these questions then you got a lot MORE than you paid for.

  • 6 y/o vacuum… Seems a fair life for a quality product. Try contacting Dyson and see what they say but seems you have had fair use from it.
    Now you can try a Miele :-)

      Still have an almost 20 yrs old miele somewhere in the shed. Still runs quite well except the hose is literally covered up with gaffa tape… band aid method and the retraction cable coil broke. keeping it just in case our newer hoover vogue that is going very strong.. packs up..

      cant say much about my bros dysons which packed up after 5yrs. He was able to trade it for a miele cat n dog one for $100 discount.

      • I've been around a long time (sigh!) and been through a lot of vacuum cleaners too… some are utter rubbish right from the start.. :-( Our Miele (just a basic 2200w unit with a power head) is how they all should be.
        Only problem is that it is a bagged unit so if you prefer bagless you may be out of luck.
        I find the Miele bagged vacuum holds a lot more than you would expect and without the pain of cleaning a bagless. Genuine bags are available on ebay for a good price… they come from SA I think?
