Won PayPal SNAD claim - now seller wants item back

I bought a item and what I received is useless/worthless/not as advertised. The person was clearly trying to scam me. I emailed them saying lets work this out, let me return the item and get a refund which they refused.

At this point, I filed a PayPal SNAD claim and they strangely never responded to the claim. The claim was found in my favour and I got a refund.

Afterwards the seller said their email was down and couldn't respond. They are now getting PayPal to repeatedly email me asking to 'kindly' return the item. I had a PayPal phone rep send in an email that I am not actually required to return the item (the seller hasn't offered anything to me for return costs etc).

My question is, would there be any other recourse options ie civil action?

    I think it's fair to expect the seller to pay all return shipping on the motorised sex toy they sold you.

    As a seller the onus was on them to respond to the SNAD case you raised, and they clearly weren't cooperative when they thought they had all the power. Now it's up to them to suck it up, and if they value the item and its return, pay the shipping costs.

    Since you have the choice to return or not, I think you've shown sufficient ethics to even offer to make the effort of returning the item in the first place. Even if they did send you man parts instead of woman parts.

    It's funny how people were aiming at the seller in the beginning and it gradually turned to the buyer. What a turn of events! Imo you should return the item to the seller, but without knowing the specifics, it would be pointless to really advise any further.

    why don't you guys give benefit of doubt to seller ,
    1. he is a private seller
    2. as per op he did not responded to the claim
    his email could be really down, he might not received op email or Paypal email . how many of you check your Paypal account daily/weekly/monthly/never ?

    op did not say what was the item and what was problem with item. it could be just not full filled his expectation.

    • While plausible, it just seems too convienient, no response to the PayPal case. I believe the seller believed he was in the clear. The buyer gave a private seller a personal email account that couldn't be accessed from somewhere else? Who gives out a personal email account like that? Still too many questions unanswered…

    I have a suggestion for you to pass on to the seller.

    They do not need to send payment for you to post. They can arrange a pick up via Temando, apparently not needing an account with them https://dashboard.temando.com/booking

    If it were me, as long as the item is not fraudulent, I would want it out of the way.
    That is, unless you really want to keep it.
