Ebay Deals & Free Postage

Hi guys, first post (yay!)
I've been lurking around Ozbargain for a while now, and something just happened recently (today, actually!) that kind of ground my gears.
Basically on this page http://deals.ebay.com.au/Automotive-Boats/Automotive/ up the top there it says all items have "free postage" (it's actually a core part of the whole eBay Deals thing). However you'll note that a number of items on that page don't have the orange "free postage" writing below them.
The particular one I was looking at - http://www.ebay.com.au/itm/12V-13000lbs-Electric-Winch-ATV-4… - is trying to slog me for $179 postage.
I thought it didn't wash, so I tried taking it up with eBay customer support. They were about as useless as a one-armed trapeze artist with an itchy backside.
Transcript below (I've changed names/user IDs). Other than that it's as it happened. Probably got carried away with the ACCC thing, but anyway..LOL…

So as I was saying, Ebay deals say they are all "hand picked by Ebay", and "include free postage". However Item 160702688959 is trying to charge me $179 postage. That certainly isn't free!

As far as I can see it is false advertising. Here is the page I got them item off, as you can see up the top it has "$0 postage"

I checked the listing and I can see here that the seller for this item place an information to contact them first for the postage details.

Seller for this item did not specify any postage payments yet instead provided additional instructions to contact them first regarding postage.

Yes, and they are telling me the postage is $179, when it should be free as it is an ebay deal? I have contacted the seller, and they won't help, which is why I am contacting you.

Even though the item is an ebay deal it would still depends on the seller.

Then you shouldn't have "free postage" up the top of every page, as it is misleading.

When an item is placed in eBay deals it does not necessarily mean that this item is for free postage. That is why we recommend that buyers contact the sellers for this items first before going through the checkout process or comitting to buy on the item.

Actually since most of the items under eBay deals are for free postages.

That's not good enough. If you say free postage, then it should apply to ALL items!

We usually encourage our sellers to offer free postage as buyers usually buy items from sellers who offers free postage.

I am going to lodge a complaint with the ACCC, as it is very misleading. The free postage is a major feature of ebay deals, yet there are a number of items that don't have free postage. If a seller can't offer free postage, then it shouldn't be listed as an eBay deal!

I meant to say, there are a number of ebay deals that don't have free postage. I am quite aware sellers can charge postage on regular items.

I understand but in cases like this as much as I would like to have all items in free postage under ebay deals but that's not the case.

Items in eBay deals are usually items with discounted prices not items that offer free postages.

Then don't have "free postage" at the top of every page, and as a central feature of the whole ebay deals thing if you can't offer it on every item. It is false, and misleading.

So do I have a leg to stand on here? Basically my argument is that a core feature of the Ebay Deals thing is free postage. Is it not false advertising/misleading for eBay to continually state this all over their site (i.e. Ebay Deals = free postage), and then list a whole bunch of items under the eBay deals scheme that actually slog you for postage?

    You see that asterisks besides Free Postage? You need to read the fine print on the bottom of the page.

    "…Free postage within Australia applies unless otherwise stated… See listings for further details…"

    Ah yes, I see that asterisk now - pesky thing!
    I still feel it is misleading though, especially see how big a deal eBay make of the whole "free postage" thing. I also sell on eBay, and basically our search rankings were penalised until we started offering free postage across the board.

    Well last time I looked at the 'hand picked by ebay' item was clearly a counterfeit item (seller probably stole the photo from original designer item) and selling copies as they had both photo there…….so I don't trust it is an item really looked into by ebay.
