Strata upgrading security door system making all tenants hand over personal information for new fobs - can they do this?

I am a tenant in a block of units that have gates to facilities and electronic key fob access to the underground garages through a massive automatic roller door.

Recently, the strata have decided to upgrade the system and are making all tenants fill out agreements and sign documents which weren't originally required when signing our lease with the real estate agency.

On top of this they are requesting that all tenants and residents line up at the office on Saturday morning and bring drivers licenses / passports and tenancy agreements otherwise they won't swap their current security fobs for new ones effectively locking residents out of their own garages / common areas.

It seems like a very aggressive policy - and is something I haven't experienced before.

So can they simply just force this on me?

  • Cracking down on illegal immigrants living in Aus illegally. Drivers license should be enough, check with a solicitor.

  • Cracking down on overcrowded apartment. I bet you'll find a neighbour has 3 families living in one apartment. This is the easiest way to get rid of them

    • will amount to nothing really. Most Melb's city apartments are occupied by more tenants than specified in the contract. I've seen 2 bedroom apartment with 8 people inside :)

  • Are you not happy about having to sign an agreement or the content of the agreement?

    I don't imagine the agreement would be controversial, perhaps it will say things such as that you can't make a copy of the fob without the authorisation of the owners corp, or you can't sub-lease the car park without the approval of the owners corp etc. If the agreement is there for the safety of the tenants/occupiers/car park users, it's probably not the worst thing.

    As to the personal information, who are you giving it to? The real estate agent or the owners corp? Are they the same company? If the information requested are the information you already provided when you applied for your apartment, what is your concern? Is it the inconvenience that you have to go to their office on Saturday? If it is, have you asked them whether you can arrange an alternative method as you will not be available on Saturdays?

    I think you'll agree that the owners corp can impose conditions and by-laws on conditions of living in the block of units, or accessing of the car park. And I think it will be unrealistic to assume that the owners corp or the real estate agent can't, within reason, ask you to sign something that wasn't in the original agreement or otherwise amend the agreement.

    Can they force you to sign an agreement or to line up? Probably not, but I suppose you have to consider whether the one-off minor annoyance of having to do so outweighs not having access to the car park.

    We have 3 weeks left of our lease and will be moving to a cheaper unit of the same size.
