Dick Smith returns policy

I purchased a 1TB hard drive from Dick Smith (online), but the next day I see a non-Dick Smith one that is bigger and at a better price. DS's return policy says

"Please choose carefully as Dick Smith does not normally accept return of goods where you have simply changed your mind."

However their paragraph on online returns has the following line

"You can also return or exchange most online purchases at any Dick Smith store. Simply approach the sales or service counter for assistance where you wish to make a claim under our Returns Policy or the ACL, including when:

…Goods are incorrectly ordered…"

Would my case be considered a change of mind return, or an incorrectly ordered product? Would I be able to refund it?

  • If it was a Desktop 1TB External hard drive, say that you thought it was a 1TB Portable hard drive. Modify wording to the product. (Mention you don't have power, it needs to be powered by your laptop.)

    Wouldn't that be an incorrectly ordered product?

    Edit: Portable hard drives are generally more expensive, so if they offer it, say that you do not want to pay the extra, and want a refund.

    • ex disksmith manger we more then happy to do it if prodcut is seal and sellable. this power i would let get another hard drive.

  • Your case is definitely change of mind. They might let you exchange it for a more expensive one if you pay extra. Legally though, they can say no to you.

    (f) What happens if I have purchased a product online and need to return it?
    Products purchased online can be returned if they are faulty, and the fault did not arise through any misuse, abnormal use or negligent use of the product.

    Unfortunately, Dick Smith cannot offer a refund or exchange where there is no fault with the product,

  • It will be up to the store involved.
    Normally ACL states the returned item has to be defective or unsuitable for its intended use to get a full refund.
    Being unsuitable for its intended use means the item is not suitable for the use it is intended, NOT when the purchaser selects an incorrect product for "their" intended purpose.
    With the latter situation, if the item is still in its original package, unopened, then they usually will do an exchange for the correct item with cash adjustment if necessary.
    I would assume that yours has been opened and used by now?

    Some stores have a policy where they will refund differences in price if a cheaper one is found within a certain time but that is not applicable here (not DSE policy) because the one you found is completely different (size).

    For me the answer is no, but the only way to find out is to take it back to your local DSE and ask.

    • I've received the item but haven't unboxed it yet. Unfortunately the model that I want isn't sold by Dick Smith, so I can't really exchange it either. I guess I'll just have to ask my local DSE. Thanks for the response.

  • If you buy a few things from DS every year, you might consider asking them to take it back in exchange for a "store-credit" (or DS gift-card) for the amount you paid for it. They would probably be much more likely to do this, than give you cash (assuming they're not legally obliged to take it back at all).

    • I ended up selling it on eBay and losing a dollar in the process, after seeing another listing for it.
