Resurface bathroom sprayer not honouring warranty

Made the mistake of paying a bathroom resurface guy for a job that was not finished properly. Catch 22 was that he wouldn’t return unless full payment made & once payment paid - no show, then excuses & constant postponements – Been trying to get him back for over 3 months now. By the 1st month, some paint bubbling occurred around his badly siliconed edges in the shower (the poor siliconing was one of the reasons I wanted him back to fix on the first day). So what I thought were just touch ups, have turned into warranty issues - but he still won’t show up. When I tell him that his postponements & no-shows prove his intention is to NOT return, he says that’s only my opinion, but still he won’t show up.

My biggest mistake was even thinking that spraying tiles & shower base would enhance the look of the bathroom. It looks good from a distance and in photos, but within less than 1 day, scratches & a tear appeared where it was touched with something (eg a shoe). Perhaps some even happened when he was doing it as close inspection can see touched up spots.

Any ideas of how I can get this guy to honour his supposed 7 year warranty?

PS Learn from my mistake and be very wary of businesses that have no street address and only have an email & mobile contact number.

  • I was going to suggest small claims court but if you have no address, be hard to serve. Alternately you can call Legal Aid to check if email is ok? Try office of fair trading for your state and see if they can assist. But yeah not much you can do/worth the trouble without address.

      The Sheriff (Office) notifies defendants that they will be part of a legal action.
      A phone number may be sufficient enough for them to request subscriber data.

    Name and shame the business…

    Has anyone else had this problem with resurfacing? What about bath inners? I was thinking Of having this done.

    Most resurfacing places wont do floors - as it just doesn't last. This mob - http://www.resurfacingaustralia.com.au/ on selling houses Australia is a better example. Although they are I believe just a conglomerate of independent contractors.

    You will not be able to issue a claim if you don't know who the defendant is - you will need at least a real name or registered company name. If you have the latter you could perform a company search and find the registered address (doubt he is registered though).

    You could try phishing for the details… i.e "Im a new customer… I don't have much time… can I post you some photos for a quote…. great what is your address." Bam.

    There are mixed levels of success in these cases - but if you push hard enough he may just decide its easier to fix it up (then come back at night and throw a brick through your window).

    If you are thinking of having it done yourself, I wouldn't recommend having tiles/benchtops/baths/sinks/showertrays resurfaced (unless the room is not used), but cupboards seem to come up quite well. I had a quote to get our bathroom retiled with white tiles,laminate benchtop & cupboard doors, and the whole job was priced at $5000 to $5,500 installed. To have the same areas resurfaced instead cost us $2700 (though that also included spraying the showertray).It is expensive considering that it still looks painted (because the grout is sprayed too)and is very easily scratched or torn when in constant use. And this was supposed to be a very durable finish.
