eBay dilemma

I have a bit of an eBay dilemma, hoping to get some input from the ozbargain community, so I few weeks ago I won an eBay auction for the ghost edition of destiny. The auction was was from a seller that “decided he no longer wanted his preorder” and he would amend the shipping details in his preorder to be shipped directly to the winner of the auction from the JB warehouse and would arrive on launch day.

Well when destiny still did not arrive yesterday, I started to think that someone had taken money and ran. However I was contacted by the seller in the evening, say that he did change the shipping address as soon as I had paid for the order. However, on Monday he got a shipping notification with a tracking number showing it going to his address rather than mine. He says he contacted JB, who told him to contact TOLL (the courier), he said he had repeated phone calls to both and apparently the order even now has not left the JB warehouse.

The seller was very apologetic. I am disappointed, I was expecting this to arrive on launch day. I did bid and pay a premium based on that expectation.

I realise that the seller is not at fault but neither am I, I did not bid for an atleast a week delay.

I wondering what the ozbargain community would do in my situation, I would not have bid on it if I know this would be the situation. Not sure if in a position to seek any kind of refund.

  • If you want to buy elsewhere then I'd ask the seller for a refund. They're not really in a position to refuse as you could lodge a claim through PayPal as the item has not been received.

    If I was this seller then I definitely wouldn't want to be going down the claim route with PayPal as any shipping reference given to PayPal will probably show his shipping address & not yours rendering any claim you have successful.

    Most sellers, if genuine, are happy to refund without going through a frustrating claim procedure so it's always best to try to resolve directly first.

  • If the seller were to express post it to you? It's disappointing, but not really the end of the world.

    I had a similar thing from Amazon once - the missus and I both got a copy of SW:TOR - her's arrived in time… Mine was 4 weeks delayed. Of course being amazon, I got the shipping refunded (for both lol!!)

    In my view if you paid a premium to receive it on the launch date - and the buyer knew that - then you have not received what you bargained for and are entitled to a refund if you wish.

  • Not sure who's at fault here. Why hasn't it left the warehouse? If JB has stuffed up it's difficult for the seller to be responsible.

    JB's despatch system is horrible, I updated my address a week before they despatched it, yet they still delivered it to my old address. I responded to Toll when I got the despatch e-mail and they couldn't change it because it was only booked not in their system. JB just didn't answer.

    You've been made some assurances which you the seller didn't know he couldn't keep, but unless you've paid more than the pre order, It wouldn't be right to ask/expect for some sort of compensation. If you've paid more than the retail price I would be expecting something kind of partial refund.

    Another point of interest, is that be really careful when you receive it/open it, check to see if it's damaged and if it isn't be really careful, they packaging isn't good and apparently JB have posted them just in plastic mail bags. Some friends have had theirs arrived damaged.

    Another thing, EB is great for AAA launches where you can grab a standard copy and have up to 7 days to return it, at times they will even recommend it to customers to avoid postage delays to WA etc (though not everyone can get to a store) if you don't abuse this system, it won't be an issue
