Anyone Ever Reported CellPhoneShop to The ACCC

HI there, does anyone have any suggestions for me?

I purchased Backbeat Go headset from CellphoneShop http://au.cellphoneshop.net in April this year. Been happy with it but a few days ago, it refused to switch on ever since, even though it charges fully.

I contacted Cellphone shop who pointed me to their Warranty page:

Warranty

  1. Cell Phone Shop warrant to the end-user customer that our products will be free from defects in materials and workmanship for 3 months after the date of purchase by the customer.

  2. Our warranty covers only those defects which arise as a result of normal use of the product, and do not apply to any:

a. Improper or inadequate maintenance.

b. Misusage and mishandling.

c. Fire, flood and other will-of-god.

d. Damaged by a wrong voltage use.

  1. Warranty will be treated as void if any:

a. The original shipping invoice is lost or amended.

b. Unauthorized modification.

  1. Fault product for claiming replacement should be returned within 3 months with suitable packaging to avoid physical damage.

They are now refusing to swap it or anything else.

I have asked Plantronics Support and will report back…be careful when dealing with Cellphone Shop because they sell a lot of no-name brand stuff as well, and heaven knows where you will get support for the items…

  • I bought a pair of Plantronics that did the same, there is some sort of reset you can do, but after googling it, it seems they were a piece of crap and had heaps of complaints.

    So long as you didn't mistreat it, they are required by law to get the product fixed for you under warranty regardless of what their warranty page says.

    A contract with a company does not override Australian Law.

  • You'll have more success with your state office of fair trading than the ACCC at this stage I reckon.
