eBay Havent Received Item, paypal can't get refund

what I can do?

tracking number stated items was delivery, so paypal said can't get refund.

Item purchased from ebay which shipped from US, suppose sent with signature required but fedex passed it to Australia Post and australia Post said no signature required.

Seller ask me to complaint to ebay global shippment program but it forward to paypal to start a dispute and case closed once seller provided them a tracking number.

paypal case is now closed and not able to raise a new dispute again

    Sounds like your dispute is with Australia Post. From what I understand, they didn't deliver the package to you, and now sombody else has your goodies.

    eBay seller hasn't done anything wrong, PayPal certainly have no duty of care now — you need to chase down Australia Post.

    I wish you best of luck recovering the parcel. Whatever FedEx insurance (if any) is not transferable so as far as they're concerned it's delivered into the country and all rests with AP. The chances of anything positive coming out of AP investigation is slim to none.

  • Was the item value high? Unfortunately, you might have to write it off as a loss and consider insurance next time.

  • Out of curiosity, if this item was paid with Credit Card via Paypal, I could lodge a chargeback, couldn't I?

  • file a charge back from your CC bank, open a dispute

    there is a way to get refund for 100% but if any one learns it paypal wont be a safe place to buy and sell any more !

  • yes, if you were smart enough to use the CC with paypal yes try a charge back, as the item was not delivered regardless of who's fault it is, the terms of the transaction are most likely in breach. Might vary based on the bank but the last time I filled a chargeback the CC company put the responsibility on the sender to prove it was delivered to the purchaser. Australia Post is not the purchaser and I don't know of any law or condition in the consumer code that allows for goods to disappear between the seller and buyer and it be the buyers fault. Yes sellers put this cra!p in their t&c's but the consumer code doesn't support that position from my reading of it.

    And please let us know how you go!!! This is a really important issue in my books.

    P.S. I also think you found a bad ebay seller. I've had goods lost in transit (i.e. stolen by local Australia Post) a few times and the good sellers always help out.

  • i paid thru paypal by paypal debit from my bank account(not cc).

    Paypal closed the case, seller dont do anything, call ebay, ebay said they can't do anything now as case passed it to paypal. Paypal wont review the case becasue seller can provide tracking number.

    I complaint the seller thru ebay, ebay dont accept as because even though seller mentioned all delivery require signature, but refer to ebay, that CSR said the seller didnt stated signature require for international shipping(seller FAQ said all shipping require signature), also refer to their global shipping program, signature not require unless more than something. and ebay said the shipping company have confirmed they pass it to a third party(australian post), so from tracking number it already proved it delivery successfully and hence signature are not required. OMG.

    My items value around AUD160 so they don't need to ship with signature. Both ebay and paypal are protect the seller. He(ebay) advised me next time don't pay using paypal or next time don't open a case thru paypal. He said i shouldnt raise a case thru paypal however when i select the option havent received the items, ebay direct me to paypal because i paid thru paypal.

    I ask, as I do buy ebay every so often- though low-dollar items, & I usually go Paypal out of convenience.

    Very good to stumble on this thread- especially where it concerns Int'l shipping entering AU. It sounds like no matter what is oaid for/promised, you have nothing/no recourse once the goods hit the shores?

  • check with post office. same thing. They said check with the driver and he said he delivery to my company reception so nothing they can do.

    Funny, my company not even have a reception, just a main door.
