Bought used HTC M8 on ebay, but not sure if it's as described

Hey guys,

I wanted to try the HTC M8 out so I decided to get a second hand one on ebay.
Just received it now, and it looks like the phone is flashed with a non-HTC rom. (not mentioned on ebay listing)

Also, there are a few scratches on the phone and the camera lens but the listing states "It is in excellent condition."

Am I able to maybe open a dispute on eBay for this? As not everyone defines "excellent condition" the same.

I'm just not quite OK with a non stock rom and a scratched lens.

Also, the seller doesn't accept returns.

  • In my opinion, you won't go far since minor scratches and software changes isn't significantly different to being unusable in the normal products purpose in Ebay's point of view.

    You can try, you lose nothing, but I think your chances are slim.

      i'd beg to differ in terms of the software changes - that is a major difference. As mentioned i'd probably try contacting the seller first. Though a question; what's the feedback of the seller like?

    It's not a big deal to flash on a stock rom. Check out xda developers.

    • No it's not a big deal, but I just don't like the feeling of it being rooted and no mentioning at all on the listing.
      And the camera is completely blurry due to the scratches on the lens

    "It is in excellent condition but it is also used as described. It has had a case and plastic screen protector since new. I have never seen any scratches on the lense. If you are not happy please return it in the same way I sent it to you. Please let me know what your intentions are."

    So it looks like the seller is happy with me returning the phone but refusing to admit the fact that the lens is heavily scratched.
    If I return the phone, am I able to ask to seller to pay for postage?

    One of the many joys of eBay.

    Purchase a second hand phone and expect it to be brand new.

    Then be so unhappy that it is not brand new and also expect the seller to cover the return postage.

      I never said I was expecting brand new.
      And tell me, if you are in the situation like this are you going to be happy?
      To me the seller is simply dishonest.

      • The seller is being honest but neglected mentioning/did not think it would be of consequence in mentioning the camera issues. Just luck of the draw really.

    Well it is used and the seller never claimed it is in perfect condition.

      There's no need to make sure,
      No HTC Sense and the ROM name is Liquid Smooth.
      The boot up screen is liquid smooth as well.

      • Just when you said it looks like, it didn't seem you knew for sure. I'd personally just try and flash the HTC rom rather than go through the hassle with paypal and sending it back.

    Your lens might not actually be scratched. It actually is a glare / oleophobic coating that is disturbed when touched, giving it a scratched appearance. Give it a good cleaning using this redditor's method and it will remove the coating.

    If the 'scratches' go away after cleaning, you should have a reasonably good phone and wouldn't have to return it. The ROM I guess, can be flashed back to stock if you don't like the 3rd party ROM.

    • Thanks for the info, I'll look into that.
      The seller just changed his mind about taking back the phone and wanted me to open a PayPal dispute. I'll see how that goes and if no luck I'll try the methods.

  • I had an optus htc rom that was full of bloat.
    If you don't like liquid smooth, change it to something like cyanogenmod and enjoy the use of your phone with a well made and maintained rom.

  • I hope some of the guys here are not actually selling on ebay.
    I simply can't understand the logic of being ok with something important not mentioned on ebay.
    The camera is scratched - "oh the phone is used, why are you expecting it's brand new?"

    anyway paypal has decided in my favor so I'll be returning the phone back.

    • 100% agree with you - i've bought many phones off eBay and all have been as described (mostly 'like new'). Would be pretty annoyed if they were scratched up etc if not mentioned in the description.
