The Good Guys eBay Store - Price Error

Hi guys - long story short I purchased a gas upright cooker from the good guys ebay store for $73. I thought it was too good to be true but I clicked through & purchased it to see how far it would go. To my surprise I got all the emails & confirmation from PayPal saying transaction had gone through.

Of course yesterday I received an email from the good guys saying it was a pricing error& my money would be refunded on Monday.

Now I know it was too good to be true but isnt there laws on this. I understand the pricing error but is there anything I can do. If it was me as a seller I would offer something for the inconv esp as my card was charged & I am expected to wait until wed to get the funds back ..

    You could ask the question and they might give you a gift card or something, besides that i don't think there is much you can do.

    You knew it was a pricing error but bought it anyway, they admitted it and refunded you without any hassles and now you want something in return? Unreal.

    Have you never heard of Terms and Conditions? It clearly says in their terms "We reserve the right to reject any order you place with Us, and/or or to limit quantities on any order, without giving any reason."

    In addition:
    "Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and We reserve the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged."

    Go into their store and start complaining and crying while rolling on the floor. You might get some FREE tissues from them.

      PM us the time and store, we may come over as crowd to watch and support you by making some noise.

  • Doesn't TGG need to open a resolution case to ask the buyer if he agrees to cancel the sale? Isn't that how it works on ebay? They can't just cancel the sale.

  • Here's the ebay terms and conditions, though I'm not sure how much weight they carry. I imagine using eBay as an outlet to sell would mean the terms and conditions of ebay would apply, not the good guys T&C. (I have no idea though) -

    "Seller Non-performance – Sellers must honour the transaction contract. Sellers cannot fail to deliver an item for which payment was accepted, significantly misrepresent an item by not meeting the terms and item description outlined in the listing, or refuse to accept payment for an item at the end of a successful sale"

    There's more information on the ebay site too. Pretty sure if a seller listed an item on ebay and accidentally entered $10.00 instead of $100.00 as a buyout, they would incur some kind of penalty for not delivering the goods (mistake or not). Having said that, I doubt there's any legal obligation for them to send you the item.

    • There were many posts here in OzB that were eBay price errors, with the Xbox price error being most popular, everyone got a refund. So seller is in no obligation to honor the sale if it is a genuine error

    Consumer law reasonably protects sellers in the case of genuine pricing errors, subject to certain conditions. In the time it took you to write your comments you could have looked it up.

    Fact is there was no inconvenience if you strongly suspected it was an error. You took a chance, they were smart enough to pick up the error and presumably correct it. They could have offered you something by way of a thank you but they have no obligation at all to do so. If they continue to make similar errors you might think it's an inducement which is a different game altogether. If they don't correct the error that is also a different proposition.

    Had you have been genuinely misled then you might have a case for approaching them with a grievance but that's not the case here apparently. Leave them negative feedback if you want or just accept the fact that they made a mistake and your attempt to take advantage of it didn't work this time. Win some, lose some.

    Just an observation. You appear to think that someone is checking prices and purchases as they happen. That's extremely rare, so your purchase will usually proceed even if prices are wrong or there is no remaining stock.

    At the end of the day they took his money which would have been making interest or paying interest on during the time of order until refund. It's not the OPs issue they made a pricing error so compensation isn't really too much to ask. Pricing errors happen all too often with these companies and they need to take some responsibility.

      Yes retailers "need to take responsibility" just as consumers need to be reasonable about obvious pricing errors. Not too difficult to send an email or ring the company for clarification in most cases (DSE and a few others aside). Imperfect world with too many employees who take little care and stock systems which are not up to scratch. Doubt very much if ANY retailer's bank account is linked to the short term money market myself.

      How much interest do you think they'd earn on $73 over a few days? If they double charged OP and didn't refund them for months I'd be a bit more sympathetic but having a squabble over something as minor as this is ridiculous. What is it that makes people so entitled to think they're deserving of compensation for a minor, petty mistake which was sorted quickly and has no real impact on their life?

    TGG were amazingly polite to the guy who knowingly tried to rip them off.
