Dick Smith Online Order terrible experience what can I do help please

On wednesday I came home and found dick smith catalogue which had Nikon d3200 twin lens kit and also used their $25 off code for online shopping.

I already had a gift card wroth $138 which I used for the purchase as well, I got confirmation mail this morning and head to the Airport West store only to find out even though it is click and collect they only had the d3200 body and couldn't find the lenses, there was an Indian descented shop attendant which is polite and helpful try to solve the issue for me, then there was another guy with few extra kilos(I don't know how to describe him without being offensive) took the matter in his hand we told him there are no lenses( box was just big enough to fit the camera and power pack) but he still open every single item in the box put them together to find out there is no lens and put them back in the box in random order!!!

Afterwards he made some calls to find out two other stores had the same issue. I left the store with frustration and called Dick Smith Call Center as I was expected it was overseas call center and the were as useless and clueless as store clerk who was dealing with me after half an hour later call center person patched through her supervisor which had to listen the story from beginning then he decided to call store only to find out store clerk cancelled my order with out asking me or consulting me.

Is it legal if it is how the hell I am going to get my refurnd obviously I lost my discount but how about gift card?
What should I do, I am thinking to take the matter to ACCC and also tell my story on dick smith facebook page but other than that who can help me with sorting this out and I still want the camera.

Appreciate your help in advance

    Whoa. Chill.

Go back to the store with the receipt and ask for your refund politely. If the shop assistant says anything other than ok (I would be amazed), ask to see the store manager.

I am not sure what they will do about the gift card, but I am sure they won't just not return the gift card part. There will be a way of dealing with it, this wouldn't be the first time this happened.

Get your refund and move on with your life, keep a watch on ozbargain for the next deal. Dick Smith are annoying with cancellations, I have had several, fortunately none where I found out when I went to collect. Tough luck. But don't act so entitled. And you will get your refund. Dick Smith aren't some fly by night outfit, or a non Australian company without a legal presence here. There is no way imaginable that you would not get a refund for a cancelled order.

Don't waste your time on ACCC. Post on facebook after that by all means but do it in a mature way - the background or the shape of the shop assistant isn't relevant, and none of them personally took your order and decided to screw you over. If you have a complaint against a specific shop assistant, make that complaint directly to Dick Smith.

Ive noticed lots of forum rants lately, most of those ranters dont even think about contacting the store and giving them a chance to solve the problem. Instead most just threaten to go straight to the ACCC.
If you mention fair trading or ACCC without letting them try to solve the issue first, chances are they'll find ways to make it more difficult for you, cause you were probably being an a-hole.

  • what can I do

Ask for a refund, and move on with your life.

You can't claim damages in Australia.

  • I didn't cancel my order or request cancellation they done that behalf of me without my permission I don't think that is normal or acceptable I wasn't taken advantage of anyone it was a catalogue item with catalogue price, after I found out they took the liberty of cancelling my order behalf of me which they have no right to do so, I ask how am I going to get my refund since payment made partially by credit card and gift card which online sales team have no idea.

On the legal side, stores can cancel your order and refund if they don't have stock. There is legal precedent for this, people have made complaints to ACCC etc. in far worse cases e.g. where hundreds of orders were involved, or there was a suggestion of baiting. The store still wasn't punished. That's the legal side.

Regarding the 'acceptability' - it is poor customer service, but if someone printed the list of worst things to happen to people in Australia today, they would run out of ink before they got yo your story. So it's a bit much asking people to feel bad for you.

The solution is to take your business elsewhere. You may be able to complain on soclal media or to a manager, if you're persistent enough you may be able to get some kind of compensation as a goodwill gesture. But not with that attitude.

What is your heritage and body shape? Maybe your personal hygiene and grammar like?

Oh, I thought we were discussing irrelevant things….

Forget it mate you guys all perfect…

      • +1

2jzzz didn't imply that we're all perfect but you did imply through descriptions of people that they were either incompetent or unhelpful. Ask for a refund, you'll get it, what more do you want? Everyone makes mistakes.

You're getting some stick because your post suggests that the first thing you notice in people is their appearance. Perhaps you don't. But if you do, you sound young, it's not too late to change :-)

+1. Honestly, what does race, ethnicity or body size have anything to do with the issues you described?

  • Have you checked your account? they should probably get your credit card money reverted but GC not sure either keep checking ur DS account

DS cancels orders and doesn't refund. I get my money back via PalPay disputes

They did the same to me. There online team is the WORST team ever. They cancelled my order and after multiple calls, I still haven't got my money back so have raised a PayPal dispute. Still need wait for 4 more days before PayPal actually jumps in.

  • Agreed, terrible experiences with Dick Smith. After spending over 5k with them annually, I'm sick of dealing with them. Don't bother trying to get your item from them, ask for a refund in writing and move on. Never deal with them again.
