Go Card Fare Evasion

Hey guys wondering if anyone could help me with the most nonsense thing that have ever happened to me.

Tonight I was coming back from work and getting to central station (Brisbane) as I always do and while talking to my wife I forgot to touch my go card and one of the guys from translink saw me and have an on spot fine of 227 dollars with the excuse that I was trying to evade the fare.

What really gets me annoyed is that I had already paid for 9 travels which means that touching my card or not would result in no charge at all.

I tried telling it to the officer who just gave me her shoulders in the classic expression of not my problem.

End of the story I left feeling like a criminal with a fine of 227 to be paid in 28 days.
I saw that I have the option of going to court and that's it, but I don't know how long it would take and I have my holidays coming soon and I'm sure that I'll be summoned during that time where I won't be here in Australia.

Anyone has any advice on what I could do? Thank

Tl;Dr - Got a fine that doesn't seems fair and wanna appeal or get it removed.

Update: I called them and was given an address to which I could write to appeal. This process will take up to 6 weeks, so I guess now I don't have a choice but wait. At least they told me not to pay the fine until they have checked the appeal.

        Unless they are trained to behave that way and not allowed to talk to the customers otherwise she is not doing a good job at all.

        I was in a similar situation before when I didn't tap on due to a malfunction at the station I got on. I too exceeded my 8 journies so there is no reason for me not to tap on. The inspecter immediately called the station and confirmed that I was telling the truth. Had he showed the same poor work ethics he would have fined me.

          Poor work ethic? Their job is to catch and issue citations to people who don't purchase a ticket - which is exactly what she did. If OP made a mistake and can prove it then that's fine, but it's absurd that you think it's a good idea that he complain about her for doing her job. Ridiculous

        • @sobes: Yes its not about issuing fines, they got to respect people and have good customer service attitude. They dont get paid 80k to issue fines and give looks and shoulders.

          A ticket inspector's job is to prevent fare evasion, not to serve customers. She could have torn the ticket up, and she could also have baked him a little cake too - both nice things, but they aren't her job. She did what she's paid for, and if there was a fair reason OP didn't tag his card then it's on him to clear it up with the company.

          By telling him he should complain to QR about her because she gave him a ticket shows an irrational sense of entitlement, but also drowns out valid complaints with nonsense like this.

        • @sobes: If everyone did just what they are paid for and nothing else, nobody would have shared deals on ozbargain. I am sure the inspector in question would not even bother about Ozbargain, they just can't be bothered.

          Where I work there is also a tap on and tap off system. It happens very often that customers either forget to tap on and then tried to tap off. We ask them a few questions and give them an opportunity to explain. Most of the time it's just an honest mistake in which we fix the problem and warn them not to repeat. There are some that intentionally abuse the system to benefit financially which we simply give them a fine on the spot.

          Ok, but the inspector saw that this guy walked through without tapping on in the first place - that is not an easy mistake to make at Central Station and every person she caught doing it would tell her the exact same thing. If he has an excuse and can prove it then that's fine, but it's on him to contact QR and explain to them. You still think that telling OP to kick up a stink and lodge a written complaint because she did her job is good advice?

          The inspector had many options. She could check the card to see if it had tapped on. Tapping on and not tapping off is completely different from not tapping on and not tapping off. One attracts the max fee and one attracts no fee. The inspect also could check if the card had maxed out the weekly journeys. It's a very simple thing to do and then exercise some common sense.

          The fact is that particular inspector had no interest in listening and following up at all. The OP has every right to complain about that. If the inspector had been trained to behave that way (fine, ignore and move on) then she has nothing to worry about. I don't agree with what she did. Neither does the OP. It's up to the OP to find out if he had been treated unfairly and that is to write a formal complaint to her bosses.

          You need to use some common sense because your understanding of the situation is flawed. When you're tasked as the only person monitoring an entrance to the busiest train station in Queensland, do you really think she can stop doing her job to investigate the story of every person who says it was just a mistake? It's someone else's job to follow up claims, it's her job to monitor the busy entrance for people who don't pay a fare (which she did).

          Keep the formal complaints for things that actually deserve it - this is not one of those.

          your understanding of her job is flawed. she can stop her job. she is not tasked to catch everyone. she has ultimate discretion as to whether she issues the fine. it is a waste of court time for a magistrate to hear the reasoning. it is a waste of time for many to revoke an issued fine.

          Don't think you understand how a job works mate - you do the job you're paid to do, you don't have to do the job you're not paid to do.

          You think it's worth anyone's time to read a complaint about someone not doing a job they aren't paid to do?

          Right or wrong there is only one way to find out for the OP. That is to write a letter of complaint and seek clarification from her bosses. There are at least 4 people in here that disagrees with you and I think it deserves it. If the OP felt so hard done by he should do it.

          Why are you so adamant that her job doesn't allow her to do otherwise? Are you the inspector? Are you one of her colleagues? Are you one of her bosses? If you are please enlighten us with some inside facts and we will rest our case.

    Another over the top thread with advice from OzBargainers. It's so simple. You write a letter explaining what happened, and mail it to the appropriate address on the website. You explain that your card already had nine trips on it and you made an honest mistake. They will either waive the fine, or you can go to court if they don't.

    In the time that you wrote this thread, read every piece of advice and replied to peoples' comments, you could have written a letter.

    I called them today and they sent me an adress to which I can write about what happened. They told me it will take up to 6 weeks and that it is better if I don't pay for the fine until then. I already wrote then so I guess now I have to wait for 6 weeks.

  • Just remember if you want to take it to court, then since your are in QLD if you are found guilty, you will have to pay the offender levy on top of the normal court cost which from memory is about $80 + the cost of trackable postage (your summons).

  • How did you even manage that? You can't get past the gates at central without tapping, and if you were hopping on a bus the driver would normally halt you if they see you didn't tap.

  • Technically not ALL journeys after the 9th journey are free. If you are making a journey to or from the Domestic Airport Station or International Airport Station, you still have to pay the full fare.

    Can we do a citizen arrest on these officers if fellow passengers or onlookers agree on what they are doing is wrong. Do a citizen arrest and call the police ? I know its absurd but can you do a citizens arrest on Govt officials and ticket checkers ? Also whats the proof that the passenger has actually evaded a fare, and why should not the checker be prosecuted as even though he or she was doing his/her job it was their personal mistake.

    I know its absurd, just trying to sweeten it up a bit for the OP. Btw the Ticket Checkers get paid > 80K + 17~18% Super to humilate people whereas hard working PSOs and Police Beat officers getting around much lesser than them

    • Dude, if you feel the need to do something, record them on video and ask for their badge ID and photo, at least here in Victoria they can arrest you and detain you until the police come… So no Citizens arrest!

  • If the internal appeal doesn't go in your favour then I'd lodge a formal appeal. And if you're going to be out of the country when your case comes up you can make a written request to have the matter heard at a later date.

    For other people's info, in Victoria the MYKI system is so severely stuffed that anyone who appeals an infringement notice automatically wins! They don't advertise this fact but if you Google you should find the news reports in the Age. The second you turn up at court the Dept of Transport lawyer gives up. It would be funny if they hadn't wasted several billion dollars of taxpayers money!

  • Similar thing happened to me. I wrote in, and they let me off. Just explain your situation, tell them about your history of buying passes every week and that you had 9 rides already that week. You'll be fine.

    also copy the letter to your local MP and the transport minister, Ministerials have a way of getting your issue to someone with authority to make it go away rather than the usual CS reps.

      They sent me an email this week saying that although they downgraded the fine to a warning. And stated that even though I wasn't going to pay the fare it's my responsibility to touch the card whenever taking the public transport
