Unsolicited merchandise from overseas sellers (Updated 29th Oct 2pm)

Hi all,

I recently received an unsolicited package addressed to me from an overseas seller.

I believe the seller has messed up with a prior order cancellation and thus still sent the item to me despite the cancelled order and refund. I have advised them in writing to organise to have the item collected from a nominated address within a month so that the item can be returned to them.

However, the seller has requested me to return the item via registered post (they will reimburse me the costs afterwards). As the item in the package contains a lithium ion battery, AusPost did not accept the package. Just wondering if there are other options available and / or whether I should just request the seller to organise the shipping themselves.

PS: they have also offered to sell me the item without any discount, but I no longer have need for the item, which is why I am not inclined to take up that offer.

After I have reiterated that they would need to collect the item from the nominated address, they are still trying to ask me to return it via AusPost.

Attached the return address, about the shipping, please pay attention to the following:
1. Send back the item WITH the original box, cables & charger, all the accessories.
2. Choose the cheapest regular airmail with tracking number ( NO DHL, NO UPS or other fast shipping, as it's very hard for us to do the clearance in HK >custom( not as easy as your country) and it will take 2 weeks or even longer to plus the high tax ).
3. Please print the attached authorized paper out and fill in the information ( ORDER NUMBER & the problems),
4. Pack the item carefully with bubble and make sure it won’t be damaged during the shipping, declare the package as "Gift " and low values if you can.
5. Inform us the tracking numbers after you send and we will inform you when it arrives.

2 more tips:) : remember to add the order number into the package. After you return, please email us, and pack it well with good bubbles especially the tablets and phone, ( Before return us, remember to remove your sd card or TF card)

As mentioned in my original email, please make arrangement to have the item collected during business hours by courier service at your cost prior to 28th November 2015.
The item will be available for collection from this address: "nominated address" at the reception desk during business hours Monday to Friday.
Please also notify me 48 hours in advance before the courier's arrival to ensure that the package is available at the said address.
The item will be disposed of as unsolicited goods at my discretion as per outlined by the Australian Consumer Law after 28th November 2015.
Please be aware that a copy of this email would be backed up for future reference.

Glad to know that you received your package. even if it has been cancelled, and the total amount has been refunded to you on 15th October, but our co-worker made a mistake, the phone still arrived to you.
Would you like to pay the money back to us? our co-worker would lose her job if we can't get money back. :(

I have just received the "item" from this order without the tempered glass protector even the order should have been cancelled.
The item is considered as unsolicited goods as the original order had been cancelled.
Please make arrangement to have the item collected during business hours by courier service from "nominated address" at your cost prior to 28th November. >Please advise me prior to the arrival of the courier company so that the item can be picked up from the reception desk.

    Yeah right…Ball's in their court,you don't need to spend anymore time, effort or money on fixing their error.

      Completely agree with this comment. Unless they arrange for a courier to come and pick it up I would put it in the corner and ignore it. No matter what they say you will not get your postage refunded; they will simply find an excuse and they may even say they didn't receive it and try to charge you the cost of the product.

    I would have just kept the item or re-sell it.

    Their error, their loss.

    Don't waste your time.

  • Its unsolicited therefore its their responsibility to arrange a pick up. I believe the law is 3 months, or 1 month if you have advised an address and requested they pick up. Don't spend time or money on it - you'll never get either back

  • I have offered seller to either collect the item at the nominated address or they can have their product forwarded to an Australian buyer. However, they basically have been harassing me on email requesting for payment.

    They also obviously didn't read my email and labelling me as if I have stolen their products. Doing the right thing is just more hassle than what it is worth.

    PS: I wonder if I should contact their OzBargain rep here as their consumer service team is definitely not listening (or reading emails I have sent).

    • Why not! Their FB/twitter as well if they have one. You want to get them off your back, don't you?
