Scammed by Fabletics?

Just looking for some advice/opinions if possible.

I bought the cheap gym outfit from Fabletics with this deal here: https://www.ozbargain.com.au/node/202717. Note: I didn't see this in Ozbargain at the time, but from a deal linked in Facebook. Mistake number 1, I know.

So I received the outfit, all good with no issues last month. I've just checked my card statement now and seen an additional charge of $70. This is when I realised that I had apparently signed up for the 'VIP membership', which takes $50usd from your card every month! This then adds to your 'store credit' to purchase a new outfit each month. You can supposedly opt out each month. I have no plans to ever use them again, after seeing their predatory tactics. Yes I know it was dumb, but it seems very unethical. Besides, who ever heard of a gym outfit membership?! There are also plenty of reviews from people who were charged for 6+ months before they realised.

My question is, is there anyway that I can get the $70 refunded? They are a California based company. The charge is on my 28degrees card, and I have Shopper protection. Does this help at all or do I just have to wear it?

ETA: Thanks guys, I've cancelled the membership today. Briefly mentioned seeking a refund, but didn't have the time to argue just then. Will try again soon. Thanks to all for your advice

  • Contact them as soon as possible and ask for a refund.

    Crazy but you always have to read the fine print before giving card details.

  • Same tactic that Amazon uses. With Amazon though a call and they reversed the charge no problems.

    As cupcake said. Contact them at first, failing this I would dispute the transaction saying you were mislead and did not know that you were purchasing the membership.

    Its not your fault when they hide sneaky stuff like this in fine print. They have to be upfront with costs and the onus is on the company to charge you what you expect to be paying..

    • It's quite good quality work out wear, but for me it was too much of a headache dealing with them.
