Access to Common Property - Remote Control to Gate

So basically like many others I have hopeless owners corporation (I live in Vic).

My remotes to my electronic gates stopped working and all signs pointed to them needing recoding. I called my owners corp for advice. They washed their hands clean of it and said I had to get in my own guy out to do it.

Basically the repairman said that the box wasn't accepting new codes and there wasn't anything he could do other than clear all codes in the system, which he was not prepared to do.

He found a work around by putting in another receiver to piggy back off the existing one.

Ending up costing me $120 for labour, $90 for parts and $100 for two new remotes.

Upon speaking to others they suggested access to the common property and repairs and maintenance should be covered by the owners corporation.
I'm now slightly confused.

Remotes stopped working for electronic gate. Owners corp did not want to help. Had to get my own guy out to do modify the hardware to allow me access to the common property. Who should pay?

  • Hi, Owners Corp should always be working for all the owners (unless you are renting and if you are, just inform your agent), they are engaged and paid by the owners to handle the day to day operations of the building. They cannot wash their hands off just like that and should be giving you advice on how best to solve this. In saying that, I don't understand why a new code is needed. Can you not use back the old code? If there's a fault with your remote, it's your cost but if there's a fault with the main controller/box, the owners corp should pay for it. In this case, it's not actually a FAULT with the main controller, so you need to find out what's wrong with your remote first and why can't you reuse the old code? bear in mind, if you tamper with the main controller and something went wrong later, you may be issued an invoice to fix the main controller. I am in Victoria too and I recently had the body corp changed for my apartment building and i am very pleased by their service.

      two of my remotes failed to work within 6 months of moving into my new property. I am an owner.

      I asked the owners corp for advice and if they had anyone they knew that could assist me in reprogramming my remotes. they said just call any remote repair person and I did.

      Upon inspection of my remotes he said they were working fine but needed recoding. The box would not accept any new codes.

      Some how my old remotes lost the code programmed within them and you cannot get them back, you just need to resync them with the box. As above the box would not accept any new codes.

      I'd waited long enough for access to common property which is my right as an owner, the only way i could do that was have his install another receiver. I take this on my part as my decision and understand if something happens it is my fault and could be issued an invoice to fix the main controller. However I'll stand strong on the fact i was given permission to get my own guy to repair it.

      I'm part of the owners corp committee and will review it with the other lot owners.

      • Hi dasher86, you'll be surprised how many body corp managers out there who don't really know what they are doing. The same happened to ours, not competent at all. We change our body corp manager through a broker who tender our the contract for your building and he gets his fees from the body corp company who gets appointed, so no fees to the owners. If you need to review your body corp company, let me know and I can recommend the broker

  • lol. I was a rental tenant once and got told by body corporate that I had to pay to get it fixed (another owner told me to call them). I just called my real estate that called the building manager that called the repairman and it was all fixed for nothing.
