Mislead Advertisement by SPOTLIGHT

After skimming SPOTLIGHT catalogue, I see they have some bedsheets sets "Bayside by Canningvale" at $79.99/QB with a highlighting about their "1000 thread count, cotton". With a $40 voucher from their VIP club, 2 sets can cost $119.98. It's awesome, esp if you are allergic with polyester sheets.

I came to their store, picked up 2 sets and showed up in the counter, surrendering the voucher, membership card, catalogue and ask if I've got them right. Their staff processed the payment without any further clarification.

I've got a big rash on my back after taking a nap in the new sheet / pillow cases and eventually find out they are a cotton rich (cotton / polyester blend), different from cotton in which they are advertised.
Luckily, I still retain the catalogue, invoice, their packing material..

I'm disappointed with their mislead practices (even I showed their staff the catalogue and pointed out the ad, depended upon their advices, no notice has been provided) and feel uncomfortable with my back rash.

What should I do now? Please feed me some ideas.
Thank you

Return them for a full refund. If you're really annoyed, contact the ACCC as it may be misleading/deceptive conduct under the ACL as per ACCC v Coles.

  • can you link the add ?
the online website states cotton / polyester

    i gather you've already received a refund?

Give head office a call and tell them it's misleading?

  • To Settero, I would upload a photo of their catalogue if my laptop still worked. It is broken now. I will try to upload a photo soon.
To Davo1111: I tried to call them late Sun, but no one picked up the phone, should I email them?

You didn't notice it on the packaging then? If I had an alergy, I'd tend to check the packaging rather than simply relying on what I saw in an advertisement. The people who put together catalogues sometimes simply get it wrong.

This. It could have just been a mistake in the catalogue.

    • Yup. Why wouldn't you check the packaging??

Apart from possible genuine mistake in the catalogue, the item could have been misplaced by another customer. If there was a cucumber in the banana section, you wouldn't just grab the cucumber without looking/checking just because the sign said banana.

  • First world problems….

  • Hi Settero: this is the link of their ad http://files.ozbargain.com.au/upload/149422/35514/bedsheet_1…
They have it printed in the front page clearly mentioning about the brand name, thread count and material. They even make these statements stand out.
For Geewhizz, thanks for your advice, I will remember that next time. It's because I saw the ad in their catalogue's front page. When coming to the store, I asked their staff about the pack and got them double check, made sure that I didn't make any mistake before making my payment. I thought that catalogue and staff advice are legal and trustful information which we could count on.
