Screwed by Dick Smith over a Fitbit

So about a week and a half ago I purchased a fitbit from the Dick Smith eBay page (which now has delisted all products). There was no movement at all on the purchase except them happily taking my money very quickly.

I have called twice, the first time i was told the order was sent to a location with no stock so they relocated the order. Days passed and still no movement so I called again only to be told the second location "had their stock stolen".

It isn't looking good for my fitbit, what are the chances I will receive it? And what are my options from here? I paid with PayPal so i assume last option could be taking my money back.

    You could try visiting a store in person to pick it up.

    But if I were you, I would immediately lodge a paypal claim and try to get your money back.

  • Give a store with stock a call, some staff are incredibly friendly and helpful. I swapped a smashed Z35 yesterday without having to deal with warranty process. (Did have to drive 22km each way though!)

  • Interesting point about the store having stolen stock. If I had a gift card for $500 and they refuse to refund or honour it, they are morally in the wrong as they have essentially stolen your money. Would you have any morale objections to simply stealing stock off the shelf to that value? I understand this is illegal but in the grandness of the circumstances it looks as though many people have taken it into their own hands to recover the costs? Could/would you do it?

    • Unfortunately or fortunately we have moved away from bankruptcy being a criminal offence. It was a criminal offence in Victorian England, with jail time for offenders. However, this is no longer considered theft, but simply that you are a creditor.

      It then depends on your view of the morals of bankruptcy. The Americans view it much more leniently than we do, but the government is trying to make bankruptcy and restructuring easier for individuals and companies in line with the American model. The hope being that everyone is better off.

      Remember with bankruptcy only the administrator wins as they line their pockets first before paying anyone out.

      I personally agree with your point around morality, but at what point do we encumber individuals and companies for getting it wrong?

    • I did it. Its under review and PayPal has requested DSE for an update by 15-Jan. Not sure how it will go.

      • If you funded it with a credit card you should be fine.
