Issue with One Plus One, Purchased from DWI

About 3 months ago i bought (from ebay dwi deals) this OPO mobile and now It started to fail like getting over heated, continuous reboot, screen is not responding to touch.

I have raised this with DWI-Ebay and they have asked me send the phone for repair warranty.

I have paid using Paypal, can i raise a Paypal dispute straight forward or wait till the phone gets repaired?

Any help on this is much appreciated!

All references in the User Agreement to “Opening a Dispute within 45 days” have been updated to reflect “Opening a Dispute within 180 days.” The Sections these changes appear include the Introduction, 3.15, 13.2 and 13.5.

    you don't need to open a dispute, because there is only 20 days it can remain open before it auto-closes. If you don't want it to close, you'd have to escalate the problem to a "claim" where Paypal will review it.

    • Sorry but I'm unable to understand about 20 days and auto-close.. Would you mind explaining it further please?

        Your ability to raise a dispute will end on April 12, 2016.

        Here's how a dispute resolution works:

        1. The buyer clicks "open a dispute" in the Resolution Centre.
          There, seller can read customer services messages you’ve posted about shipping delays or other issues.
        2. If the buyer pursues the dispute, they describe their concerns online.
        3. Buyer is notified of the new dispute by email and on account overview page.
        4. Seller and the buyer communicate directly on the PayPal site. If the seller does not respond, the buyer may escalate the issue to a claim.
        5. If the dispute is not escalated within 20 days, it is automatically closed.
        6. If the problem remains unresolved, the buyer escalates the dispute to a claim and PayPal reviews the case.

        The thing about the dispute — disputes can only be opened once, and there is also a time limit of 20 days where the you must either take action (and get Paypal involved where they can decide in favour of the buyer or seller), or the alternative action is to just let it be… but this basically signals that you don't want to take further action, so the dispute is cancelled.
        You don't want that to happen since we're not sure if DWI is going to send you a replacement yet…

        Once the dispute is closed it cannot be re-opened again via the website, you can only do so by calling Paypal.

        I wouldn't of course, be too hasty to open a dispute if your intentions are to get the phone fixed. But rather wait it out until DWI responds to you and gives you a replacement handset. If you get nothing conclusive or if they run out of stock, then by 1st of April open the dispute.

        If you just want your money back and no longer a replacement then open the dispute, and let Paypal do the rest.

    My One Plus was from DWI. Had an issue with it, sent it to Sydney for repair and was back within 2 weeks or so. No need to lodge a Paypal dispute. Link to issue from 2014.

    • I will send my phone to repair center and if it's not fixed, then I'm thinking to raise it with Paypal.

  • PayPal or ebay will also reimburse you for return postage.

    Need an advice on this.
    Sent my phone for repairs, its been 5 weeks and when I sent a follow up email they replied saying

    "Sorry for the delay, we notice that the item is still under repairing.

    We would like to off a RMA replacement (not brand new but it must functional) of Asus Zenfone 2 ZE551ML Quad Core 2.3G/4G RAM/64GB Dual Sim 4G - Black under special arrangement."

    • Shall I still wait for my device to get repaired or shall I raise it with Paypal?
    • Shall I accept replacement phone and wait till my device is back to me?
