Never Got Paid for 2 Weeks Training.

Hi All,

Hopefully somebody can help please. My husband completed two weeks training at a company and was informed he would get paid $$$ a week for working full time until he finished his training. At the end of the two weeks he realised the job isn't for him so handed his notice in and found work at another company.

The company said they would pay him on the 14th August for the work he completed. Anyway it's now the 17th and nothing has been paid to him. He would have been working as a subcontractor. The guy who pays the wages isn't answering his phone to him and not returning his calls. My husband has called the main reception desk and they informed him he needs to speak to the guy he is trying to contact.

He completed all the paperwork with the company and handed them his bank details etc. My husband never got anything in writing about the training pay, so I am thinking now he isn't going to get paid for the two weeks he worked?

We could really do with the money.

Thankyou

If I have read this correct, he did the 2 weeks training and decided to leave. ie. did not end up working there.

I truly hope they do not pay him.
He did the 2 weeks training, at cost to the employer, and did the runner.

He now probably intends to use that training elsewhere.
Why should the company pay him anything - where have they received any benefit?

    • I definitely wouldn't want you as my boss!

Why should an employee not be paid for training? They have given their time to the employer by attending the training and should be paid.

Besides, there was an agreement to pay on the 14th August.

This is straight from the Fair Work website (https://www.fairwork.gov.au/pay)

Employees have to be paid the right pay rate for all hours they work, including time spent:

      training
      in team meetings
      opening and closing the business
      working unreasonable trial shifts.
Learn about pay obligations, including minimum wages, pay slip and record-keeping requirements and the rules regarding unpaid work.

I agree with you, I have friends who had training at Crown, and after training quit just to get the money. This employer here didn't cooperate with his contract properly.

OP, you might consider escalating this to the police, or even try to sue the company if you feel like risking it.

OP, you might consider escalating this to the police

what exactly is police supposed to be doing in this case ?

  • He is not using his skills elsewhere, he quit because he didn't really get taught anything. The lad they put him on site with was on price work so my husband wasn't really trained because he just rushed to get his work done otherwise he wouldn't get paid for his work either. My husband has worked within the building trade for 20 years (just somethings are done differently).

  • Reread the contract and see if there are any cooling/probation clauses that allow them to deal with early leavers. That is your starting point.

I think there is another problem here.
You say "he would have been working as a contractor"???
In that case, he normally wouldn't get "wages" or "training pay".
So - is he a contractor or an employee?
If the former he should issue an invoice to the company. If the latter he should chase it up with HR, then notify Fair Work.

  • Hi

Yes he would had been a contractor but for a company that supplied him work. He would get a percentage of a job fitted.

There is nothing is his contract to say about the training it was just verbal I think. I don't think he has a leg to stand on.
Two weeks for nothing it looks like.

Aparantly that's how the compmay works, two weeks shadowing an other contractor (not really training) on not so good money then you get paid a percentage of the jobs installed. The work just wasn't for him but wanted to stick the two weeks out just to give it a good go.

  • 2 weeks is giving it a good go?

    ok
