Vaya Mobile's False Advertising about Their Unlimited Mobile Plan

Hi there,

I am currently on Vaya's Unlimited mobile plan but the plan is now restricted so I can't make a phone call anymore..

I called their customer service number to discuss about it and they said the "Unlimited" plan is actually "limited" to $4000 of standard national talk and 2000 SMS.

Did anyone know about this? I was shocked and still am. I know i made a quite huge amount of phone call but it wasn't for commercial purpose that I can prove.

I thought there was no limits on this unlimited plan.. It feels like Vaya is promoting and advertising their unlimited plan in a deceptive way..

Vaya should've mentioned the fact on their Web or the plan shouldn't have named as Unlimited plan.

Plus their customer service is so bad.. I was talking with Ivy from Vaya but she hung up on me…

What should I do..? and I want Vaya to stop advertising "Unlimited" plan because it's not fair…

  • Do you have proof of these messaging and call limits?

    All providers should provide a fact sheet for every mobile plan that it offers, often termed a 'Critical Information Summary'.

    All phone plans, regardless of provider, are subject to a "Fair-Use policy".
    I just looked up Vaya's policy, and it does say that their definition of fair use is 4000 minutes and 2000 sms.

    Find another mobile plan.

    Find another mobile provider with better customer service

    Find a way to make less calls.

    how can I stalk my ex if I can only send 2000 sms a month!?!?!?
    4000 minutes?!?!? that's only like 12,000 voice mail messages i can leave.

    doesn't suit my current lifestyle.

  • That is a huge amount of calls and texts. Fair usage comes in play to allow others to use the network. I think most "unlimited" plans have fair usage clauses in them. You need to look elsewhere or find another provider to play with.

    Unlimited = no limits, if you don't offer that, then don't call it that.

  • 2000 SMS, I'd burn through that in a couple days !!
    I've been warned by Optus before about excessive texting and was told I'd be cut off. I moved over to Virgin and had no such warnings yet…….

  • They should just say "practically unlimited" and it would feel better to me. Of course, even without fair use you are limited to 24 X 31 hours of call (or even less! :-)

    Optus got dragged over the coals a while back for the exact same reason
    said they had unlimited home broadband but i was limited to 100GB then slowed… so even thought it was unlimited.. it wasnt unlimited at full speed or something.

    More than 4000 minutes and it's not commercial? Pardon my skepticism.

    • 4000 / 60 (minutes) / 28 (days) = 2.38 hrs per day.

  • Hi hioz, we just spotted this thread and wanted to jump in and clarify a few things. At Vaya, we do not have a minute or text-based cap on the number of calls / SMS you can use each month on our Unlimited plans. Please refer to section 15 of our Fair Use Policy. You would’ve seen the reference to 4000 minutes in Section 3 of the policy – it’s referring to ‘free time’ or ‘flat charge’ calls, which were features of some of our older Vaya plans that are no longer available. If you’ve got any other concerns just let me know.

  • The onus is not on the consumer, but the advertiser. ACCC would have a field day if what OP says is true - clearly misleading to call something "unlimited" and then place in the small print limitations on this.
