GyG Online Order Gripe

Hey ozbargain,

I recently ordered some chicken burritos from my local Guzman Y Gomez using the iPhone app.
When I arrived to pick up the order I was told that they had no chicken left so they did not cook my order and asked if I would like beef instead. As both myself and my partner wanted chicken for dinner I told them I would pass on their offer.
I then asked for a refund only to be told they could not give me one, instead I would have to give them my email and they would send me details on how to obtain a refund.
Ok fine, I accepted that.
When I received the email it had a 'web order refund request' form attached.
1. You can't fill the form out on the phone or computer so you have to print it out.
2. You are required to attach a copy of your bank statement.
3. They want the form emailed back, meaning I have to scan it back into the phone or computer after filling it out.

So ozbargainers my question to you, is this legal?

    how did you pay ? if by cc , call the company and request a charge back, should not have to jump through hoops to get a refund.

    • Was already thinking this. Not sure how hard it's going to be through Suncorp. I am more just curious if this type of refund procedure is legal under consumer law. Especially the whole requesting a bank statement. Isn't that a privacy issue!?
