Workplace Compensation NSW - Lawyer Problems

Dear ozbargainers,

I have had an injury for a year from a work accident due to works unsafe work conditions. There was one witness but they are the relative of the boss so they won't be on my side.
I saw a lawyer and they said that it is better to drag out the case longer to that we can get a higher payment. I have hospital bills and expenses.
However, I'm not sure if this lawyer is right. Because my visa expires next year and she said we would go to court this july but nothing happened. She said I didn't need to organise anythng and she would organise all papers for court. Not sure if she even is doing that?
Well I returned to work, I am not sure I will be getting any pay for delaying this too long. What are my rights? I am still living with back injury. Is the lawyer trying to hold out till my visa expires and ignore the case?

    I would advise you to talk to another qualified lawyer and not some self-proclaimed law experts on OzB. :)

    Why would they do that? Are they billing you now?

      No they said they'll take 10% of win

    1. Have you put in a claim with the Worker's Compensation insurer?

    2. Have you had surgery or has it been recommended? If so your lawyer is correct as it usually is better to wait until after surgery, however why haven't the bills been paid by the insurer so far? Seems a little odd.

    Any lawyer who specialises in this area and will give you a free consultation, so probably go down that path.

      I have claimed work cover and have my bills already

    Take it to court and the witness can be subpoenaed. She/He will have to testify under oath.

    Why don't you ask the lawyer what she is doing with your case? no one here knows the intentions of your lawyer.

      He finally sent a letter out saying we going to plead to go to court within 12 months waiting period. She only started action when I brought my cousin who knows more
