Agent Taking Money from Bond

Hi guys, So I am located in QLD & basically this is the situation. Lease was ending 28th, gave the usual notice etc, on the 27th the owner changed the agreement from a Private rental to an agency rental. House was cleaned to a high standard etc, gave them an entry report & keys on the 28th, they have done their exit report on the 3rd, which is outside of the 3 business days allocated in the legislation. Has anyone successfully argued that this is a break of contract and had the bond returned in full? Do you think this is possible? tia

  • Unless I am mistaken, as the renter, you are required to fill out and send off a form requesting your bond back in full.

    Then the Real Estate Agent will make a claim for damage, with substantiated evidence and quotes for repair cost, for any damage.

    They cannot just 'hold onto your bond'.

      This is perhaps the best advice you will receive. Fill this form out ASAP and lodge it.

      If the agent is yet to lodge a bond refund request, your form will triger the start of the process.
      The RTA will contact the agent to confirm they agree with your requested refund amount.
      In the event there is not a consensus the bond at that point is held and a mediator is assigned to the case.
      A 3 way phone call is scheduled where the mediator will ask the parties to come to an agreement.
      In the event an agreement is not reached, an application to QCAT is the next step.

      The information you have provided is not clear, however if the agent is to be awarded any of your bond they will need images demonstrating the condition at the start of your lease.

  • Yeah so i completed the exit report and left the keys in the property, they then took 5 business days to fill out their exit report, 2 days over the allocated time slot. They are asking for big $$$ for cleaning, fair enough $200 or so but i feel $900 is excessive. Cleaning of an oven tray, light switches, shower, and a few light fixtures. Repair of a door handle (wear an tear as it fell off),cleaning of windows outside, and repair to the fence which is clearly broken on the neighbours side not mine. But what i was wondering if, if they haven't completed their form in time, doesn't that make our contract null & void? How can the rta be sure of the condition i left it in as a time frame of 6 days anything can happen. Rain etc,

        No it's all cleaned, but i am a fair guy, I can understand if they think it's not up to their standard. I do admit i missed one light fixture and 2 or 3 other spots, but geez that's not in the ballpark of $900. No scam. I feel the agent took too long to do the report and I shouldn't be held to the same standards as time as lapsed.
