Paternity Leave

Hi, I work for one of the nursing homes in Adelaide. My wife and I had a baby in last August. Both of us work in different nursing home. My wife gonna finish her maternity leave in February at her work. Now I'm planning to have paternity leave at my work, after she return at her work. I will be primary carer at that time. My questions are:

  1. Am I still eligible for paternity leave when my baby is 6 months old?

  2. How they count leave hours as they said in leave form "they count average hours of last year" ?
I work as part time permanent having 50 hours fortnightly permanent, but I pick up extra shift every fortnight to make 76 hours.
I'm sure that I have worked more than 70+ hours fortnightly last year.
Do they count average hours of permanent shift (50hrs) or total hrs which is 70+ hrs (permanent + pick up)?

Thnx

  • Are you employed on a contract, under an award or under an enterprise agreement (ie union deal)?

If you are, then check those first, as they may be specific to your role (admin, AiN, maintenance etc) or workplace, and may have extra provisions.

  • On contract, working as a carer.

  • Thought about asking your employers/HR…?

    • ..Union.

  • Are you asking about paternity leave from your work or the government paternity leave? If government this should be able to help you out

    https://www.humanservices.gov.au/customer/services/centrelin…

It doesn't say anything about the time limit of when to apply but they do have a work test - https://www.humanservices.gov.au/customer/enablers/work-test…

    It's only 2 weeks though.

  • Not from the government, from my work.

    • +1

Ahh, then it's probably best to ask HR or your boss. Different companies have different policies.
