Statutory Warranty - What Is Covered?

On the 13th of November, I purchased a car from a dealer.

The car was under 5 years old, and the dealer was where the vehicle was purchased new, with full service history through the same location.

As the purchase was through a dealer, the car came with RWC, though I live in Canberra, and the car was purchased in Sydney, so a new certificate was required.

When I had the car inspected for a new certificate, I was told that the brake pads all needed replacing, as did the rotors and two of the tyres - the car was effectively unroadworthy.

I called the dealer, who said that they were liable, as the car was sold with a RWC, but only agreed to pay half of the costs. The requirements are very unclear under the NSW Fair Trading page, though the car definitely came with statutory warranty.

The car's mechanicals were also inspected by a third party organised by me, but I (probably erroneously) assumed that a RWC meant that the car would at least be able to be registered here. I didn't inspect the car personally before purchasing, as I was in Canberra, and could only make it up on one particular day.

My question is, then, what am I entitled to under the statutory warranty? Should I be demanding that they pay for the rotors, or would that constitute fair wear and tear? Should the tyres or brake pads be covered?
The dealer was very quick to offer to pay for half - are they covering themselves?

Any advice would be greatly appreciated!

  • Brake condition is not checked for RWC in NSW, the car just needs to be able to pass a brake meter deceleration test. But they should pay for the tyres if they are unroadworthy. Between you and him for the brakes.

      The Veloster is still going strong. I've had one issue with the paint so far that was covered under warranty.

      This car had RWC, and I organised an NRMA inspection before I went up to Sydney, and got the all clear. The car is an LW Focus Titanium Diesel with low km, and it's replacing my partner and I's second car, which is falling apart.

  • I bought a car with a pink slip (RWC in NSW) that was due to be re-registered. It had two tyres that needed replacing, the inside edge was bald. Think there may have been something else too. I bought it knowing these things needed reload and paid a fair price. I also bought it knowing the dealer had done a dodgy pink slip becuase it was showing as roadworthy, but clearly not.

    Used car dealers, need we say more?

  • You know what they say about a deal that looks too good to be true.

  • I'd contact NSW Fair Trading and ask them about it. They are very helpful. Until you do that, you're just guessing.

  • OP how did you go with the repair?

    Did the dealer covered the full cost? and how did they pay you?

    • The dealer did cover the full cost of things that were required to pass RWC (though it took a little arguing). As the rotors were only a warning for the RWC, I negotiated they pay half for their replacement (though they did claim they were new).

        So how long did it take to get the dealer to accept the full cost and how did they paid you?

        • Pretty much straight away. We paid, and they reimbursed through direct debit. All went quite smoothly, and didn’t have to drive interstate to the dealership at all.

          So do you need to whay you have said? Or you just pass the phone to your local mechanic and theybsort it out themselves?
