Hyundai Sonata Involved in an Accident on M80

I was involved in an accident on M80. I was not able to brake, even though I had pressed the brake and hit the car in front. They were was just able to brake and not hit the car ahead.

After a few days Hyundai Sonata had a ABS and brake liner recall. Can I go to Hyundai and claim for repair charges, as the brakes had a history of failure for this model?

My car is insured with AAMI, I have asked them if they can go to Hyundai to claim for repair charges, but have not received any response from them.

What can I do to claim expenses, I have written a letter to Hyundai explaining the situation, waiting for the response from them.

    In the situation above i imagine it is a fairly simple head to tail crash?

    The issue is with the ESC not your ABS or any other system. When ABS kicks in it may feel like there is no brake pressure happening as the brake pedal will depress all the way and the electrics will take over. ESC is different, it automatically brakes when it detects a loss of control. In this crash the ABS would have kicked in nothing to do with ESC

    Am i misinterpretation the situation? If not then theres no chance of you claiming back costs from Hyundai

  • How many kms on your car, and how old is it? Good luck proving it wasn't just badly serviced

    you hit the brake but obviously the speed you were going meant you couldnt stop in time

    this isnt a mechanical issue, its your perception/control issue

  • Unless you can prove that the brakes did fail or malfunction due to a manufacturing / design defect when you tried apply breaks to avoid hitting the car in front you cannot claim anything from Hyundai.

    The recall does not mean your breaks are faulty and malfunctioning.
    It only means there is a increased chance that they can malfunction.
    Maybe the breaks did not malfunction but you did not concentrate on the road and maintain a safe breaking distance.

    Hyundai Sonata may require a replacement of the brake booster and/or brake lines.
    During manufacturing, these parts may have been fitted incorrectly resulting in either higher effort in applying the brake pedal and/ or wheel lock under extreme braking manoeuvres.

    To correct this potential concern we request that you contact your nearest Hyundai dealer as soon as possible to arrange a mutually convenient time to replace the brake booster and/or brake lines leading from the Anti-Locking Brake (ABS) control module to a brake union connector. This work will be carried out free of charge through your Hyundai dealer.

    According to the above recall from Hyundai "higher effort in applying the brake pedal and/ or wheel lock under extreme braking manoeuvres." even though you have had space and applied brakes at the right time the car did not stop.

      And were you informed of the recall a year ago?

  • Yes ny car was part of the recall, i got an email from Hyundai saying i need to take my car to Hyundai dealership and get the brake pads, brake liners replaced.

      Kinda negligence on your part, if they alerted you to the recall, and you didn't get it done

  • Hyundai sent me an email a month back, next day i foxed up an appointment to get the brakers liners and boosters replaced from hyundai dealer.

      you claim that you had this problem fixed the day after you received the recall notification. this recall was made public more than a year ago. how can you possibly blame this collision on the recall now?

  • I bought the car in June 2016, Hyundai should have instructed its dealership if the cars were part of the recall to have it fixed before they were sold.
