Condition of Product When Eligible for Repair, Replacement, Refund under ACCC

I'm eligible for repair, replacement or refund under ACCC because of a manufacturing fault which is acknowledged by the retailer. I also dropped the product which caused some visual damage however this is unrelated to the manufacturing fault. I would be seeking a replacement or refund. Would there be any issues where they could reject my claim because of the visual damaged? I have talked to the retailer through online chat and plan to go into the store on the weekend.

  • i recently have experience with Sony. they offer 4th time repair (after 3x repaired an broken again) - they offer replacement but i dont want because different model. when i mentioned ACCC they said we will stick to our offer of repair or replacement please welcome to ask 3rd party opinion HUH SONY YOU ARE SO RUDE!
    so i did took it up to ACCC and they melted like butter in the summer and give refund in 3 days.

      Oh, they gave me a refurbished z2 after 3rd repair.
      1st repair was my fault (no visual damage though, just the camera was funny)
      2nd repair was theirs (z2 water vapor present internally even though the ports were all sealed)
      3rd repair was theirs too (power button ring fell out)

      Wasn't unpleasant, did it through with fonebiz, their online team was great, their repair centre wasn't unpleasant, but not outstanding either.
      Just a little inconvenienced while I waited a week for the repair to be carried out (you can get a label and buy a small box to send it to them too, just takes like a week longer).
      Microsoft's warranty service is really really good. It's like the online version of Apple store but no genius appointments, just couriers to pickup your item and that's it, they'll send out a refurb (labelled as a refurb but it's practically NEW)

  • How about some more details? If you dropped a phone or laptop, yeah you can expect them to just offer a repair (and that's if the breakage didn't cause something to warrant the need for a replacement)

    Jees, all these people screaming up and down about ACL… local price are gonna go through the roof in the coming years, with retailers having to allow extra money for replacements.

    I'm guessing it's a tablet or phone. So I'd say Yes. They may be able to reject your claim for a refund or even repair.

    Take the iPhone 6s unexpected shutdown for example.

    "Note: If your iPhone 6s has any damage such as a cracked screen which impairs the replacement of the battery, that issue will need to be resolved prior to the battery replacement. In some cases, there may be a cost associated with the repair."

    In other words you'd have to pay the fee to have your iPhone screen fixed.
