House and Land Package, Should "a Final Identification Survey" Be Charged by Customer

Dear folks,

We have exchanged contract for House and Land Package in Oct 2014. The land has been settled in Aug 2016. Our builder sent Development Application to the council in Nov 2016, however we have been told that a final identification survey is required to get the final occupation certificate when builder complete the house. And the builder vary our Home Building Contract by charging "a final identification survey" ( $415) to us since the builder say this cost was not including in our original contract tender. We are not sure whether it is a reasonable and fair charge? Because as we are aware, other customer with the same builder do not have the variation raised or maybe other customer was not required by council to perform "a final identification survey"? We just cannot fully understand this matter. If anyone could help here would be very much appreciated.

  • Contact council to check their requirements for occupation certification and whether they have changed since Oct 14.
    An identification survey is a standard and foreseeable cost.
    Who sold you the house and land? First and second tier providers would typically disclose these costs upfront.
