Vodafone Could Not Repair Nexus 6P Still under Warranty

Hi. This is my first post on this forum. Sorry for long post

i am currently on a vodafone 55/month $0 phone plus $55 plan (after $5 discount on $60)(4gb data + 150 international call)nexus 6p 32gb phone from May 2016. Recently my phone shut down all of a sudden while using. could not switch on and charge after that. gave phone to vodafone service center for repair. after a week (today)i got a text saying they could not fix it and a asked me to call them and if not responded would return my device unrepaired.
so i called them and they said they do not have any nexus 6p to replace and offered me some other smart phones such as huawei g8 and samsung galaxy s6 edge. but i am not interested in those and any other phones since i like stock android and prefer it over any other phones. And i miss my nexus 6p very much.

CAN THEY BUY me Nexus 6p from available stores and replace my damage phone?
is galaxy s6 edge worth a replacement for nexus 6p?

And if i am not interested in any of their phone offers, what can i do? since vodafone does not have very good phones on plans

i noted this in their terms and conditions.

  1. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a REPLACEMENT or a REFUND for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Will they REFUND me money or what? so that i can buy new phone of my choice

  • If they refund, it will be pro-rata'd based on how much good use you got out of it. I'd guess a SG6 is about the same, but I'd maybe push for a 7 since it's about to be replaced

    • they said they cannot refund since it was a $60 plan with $0 upfront for device.

      so if i do not want their device since they have been offering only low range phones than 6p, and i dont want to pay extra for other phones will i end up with nothing?

  • Repairs
    If the problem with a product or service is minor, you must accept a free repair if the business offers you one.
    If the business fails to give you a free repair within a reasonable time or cannot fix your problem, you can:
    - get it done elsewhere and pass on the costs to the business
    - ask for a replacement
    - ask for a refund
    - recover compensation for the drop in value below the price paid.

    Can't you deal directly with Google for warranty repairs? I recall some posts here stating that they were pretty good most of the time.

      And hey, do vodafone price match phone plans from other carriers for same device.

    Google will cover the warranty if Voda can't.

    Get it back, take it to Google, get it repaired/replaced through them.

    That's the best possible situation, assuming Google can give you a 6P

      May even get a pixel. The production of the 6p stopped and they are 'completely out of stock.'

    • thanks for reply mate. i contacted google and they said they cannot repalace or repaire the phones that is not bought from google store. they advised me to go for huawei and claim manufacturer warranty

        • Yeah. After speaking to 4-5 vodafone representatives, who just wanted to settle me with huawei g8 which is half the price of nexus 6p, one finally said they will replace my phone with another nexus 6p before 26 jan.
          Hope they send new one and not the refurbished. 😆

          Yes, they replaced my 32gb nexus 6p with brand new Nexus 6p 128gb on the Last week of January 2017.
