Need Advice, Accident at Hotel, What to Do

Hi, a family member had an accident at one of the big hotels due to failure of the hotel to make sure that the swimming area was safe. What is the best way to deal with this? The family member now has a scar as a result of the accident. The hotel has refunded the money for the hotel stay.

Several of the tiles in the pool were razor sharp.

    You accepting the refund for the stay might be your resolution to the problem.

    What was the negligence of the hotel? Wet floor… around a pool?

    I'm not a lawyer and might not be giving the best advise. According to what I know, under commonwealth law, you can't get benefit out of nothing.

    To establish a claim, you first need to prove your lost. So:
    - If the person suffer lost due to the accident, for example, you can't go work
    - If the person has some medical expenses due to this
    - If the person has financial lost due to the accident (e.g. the person is a model and not able to work due to the scar

    Prove must be provided (e.g. payslip, medical bill, etc). You might be able to claim for damages.

      Proving the loss comes third to proving a) the hotel had a duty of care to the person, and b) they breached this duty of care.

    You could contribute to the further degradation of society by filing a frivolous claim against the hotel for "medical expenses" and "pain and suffering" or you could be a decent human being and move on with your life. Sad to see the litigious society of America taking hold here in Australia also.

      Maybe make a claim on Travel Insurance…

  • Has a scar, but did they undergo surgery? You got your hotel stay refunded… that should be pretty good if no surgery

    wife slipped at the pool while in thailand a few years ago, busted open her chin. The hotel paid for all her medical costs, and also refunded the lodging and upgraded us to the next level of suites. I consider that reimbursement, it was an accident and no one was to blame
