A Private Company Hiring Only Oz Citizen, Can This Be Considered as Discrimination?

I came across this job ads in Seek with a requirement "Due to company policy, you MUST be an Australian Citizen to be considered for this role".

I can understand if it is a government institution as the role could be confidential, but for a private company requiring such citizenship is a bit odd. It's just like discrimination based applicant's age, sex or race. Is this acceptable policy for a private company?

    • Yeah, that's the one mate! Hope you meet that requirement.

They might be subcontrators for Government. There would be a good reason they would write this.

No. This is because they may not have the capacity to deal with the legal aspects of hiring somebody on a visa. It isn't dealing with a person's race, disability, gender or sexuality.

Alot of jobs have a prerequisite to be an oz citizen, most government jobs for example.

Australian employers could face infringements or civil penalties if they allow illegal work regardless of whether they knew someone was an illegal worker. We expect employers to take reasonable steps to make sure they are not employing, referring or contracting illegal workers.

An illegal worker is a non-citizen who is working without a valid visa or working in breach of a visa condition. Not everyone who comes to Australia on a visa has permission to work.

Seems perfectly sensible for an employer not to have to check 57 varieties of Visa conditions.

Totally reasonable to want an Australian Citizen for a variety of reasons. It ends up like the boy who cried wolf if you keep saying these sorts of things are discrimination.

Yes, they're being discriminatory in who they employ, so what.

Every employer discriminates towards certain potential employees, so what. I doubt anyone in this world is always fair and just.

Anyway, nothing wrong with the requirement to be an Australia citizen due to law and tax issues.

I went for a job as a surgeon at Brisbane Hospital and they discriminated against me because I didn't have a medical degree. I have my own knives, that's half of the job there.

    Hmmmmm

its not going to keep me up nights…..

  • I don't quite understand why private companies want Aussie citizens only but excludes PR tho.
