Collecting Refund -Dealing with Dodgy Company

i bought a transmission from an interstate wrecker yard 8 weeks ago, the transmission was diagnosed faulty and subsequently returned back to the wrecker.
Wrecker is blatantly ignoring me despite leaving numerous messages, and is taking his time processing my refund. The part is covered by a 90 day warranty and is deemed unserviceable and therefore without repair, replacement im entitled to a full refund.

Ive sent this dodgy company a letter of demand but so they've also ignored it. I've lodged a claim with the NSW fair trade office but i suspect he's also fobbing them off with lies and unsubstantiated facts.

We're talking $630 here. What would be my next course of action? I bought this by direct deposit and hence my bank would not be any help with reversing my debit.

      would the OP able to claim the cost of transport and cost involved in diagnosing the transmission as faulty?

    Yeah once a court date is set he will shit himself. Make sure to choose a really inconvenient court location for him and you're more likely to be paid out prior to the date.

    How long before Fair Trading action takes its course? I've never lodged a complaint with them before, but I'm assuming you've submitted all the paperwork including the diagnosis report and proof of returning the transmission.

    Is there a default judgement if the other party doesn't respond to any correspondence?

    • Yes. I've submitted all correspondence and the transcripts of the interaction in whatever limited fashion there was to fair trading commission. The agent was super sympathetic even to point where I almost heard her call him an a-hole. :)

      I like rambuttans comments and quite encouraged by it. I'm not a vindictive individual by nature but this incident has tested my patience. I've since taken the car to have a fully rebuilt transmission so I need my money to pay off my the bill.

        I don't think anyone would blame you for being annoyed - $650 isn't a small amount of money and this guy's giving you the run around.
